This would so get purple . Just because the guy sucked hard at color touch doesn't mean it's not that.

I ain't no expert but I'm chimin'

 

CGC defines restoration as treatments intended to return the comic book to a known or assumed state through the addition of non-original material. Examples of restoration include:

 

COLOR TOUCH. Using pigment to hide color flecks, color flakes, and larger areas of missing color. Examples of pigments may include paint (acrylic, oil, watercolor, etc.), pencil crayon, pastel, pen, marker, white-out, etc. Color touch is sometimes called inpainting.

 

I think the key word is "intended" and looking at this book I cannot say that there was any intent to hide color flecks in the immediate areas where all of the marker can be seen. Why did they color around the entire Marvel box? There is little chance of color flecks on the inside frame of the Marvel box next to the title logo. And why not continue down the spine? After all the "Earth's Mightiest Super-Heroes" banner is the same color as the Marvel box it it has a significant chip that could have easily been "touched".

With that amount of marker, the book will be in a Purple label slab.

 

Hate to totally disagree with you but in this case I do. The use of the marker around the Marvel box is in no way evident of any attempt to restore or repair this book. The use of the marker here is no different then someone writing their name on the book. If this was an attempt at restoration then why would the marker be used around the entire Marvel box including the white areas? No purple label here, not for the marker, that is 100% assured. If you see other evidence of restoration please identify it because I don't see anything obvious?

 

You can disagree all you want, but I have never seen a book with marker on the spine get a blue label.

 

If you could find some examples of slabs or scans that have it might help your cause or have the OP submit the book to CGC.
