One too many Tales of Terror

While looking through the OSPG, I came across Toby Publishing's Tales of Terror 1 and saw that this series ceased after one issue due to its using an EC title. Does anyone know or have any information about whether this was the result of EC taking note of this or if Toby took the initiative in canceling the book after recognizing its using the EC title? While Comic Book publishers have historically "borrowed" from one another, was the Toby Tales of Terror episode one of the clearest PCH examples of an attempt to capitalize on EC's success? Or did Toby make an innocent mistake?
