Need some advice about a damaged slab I just received 1 1

Hello! I am hoping that some of you wise comic book people can give me a bit of advice. I just purchased this copy of X-Men 101. Signed by Stan Lee and Chris Claremont. It had an old label so I planned to send it in for a cleaning and pressing and hoped to get a grade bump when it came back. I received it yesterday and realized that the right hand side of the slab seems to be damaged. Like it was possibly opened. The guy I bought it from is acting like it’s no big deal but I will be very upset if I send it back in and it doesn’t come back with a gold label. Judging by the pictures I have attached should I ask for a refund? Or is it possible the slab was just dropped and damaged? Thank you in advance for your expertise!

Did he disclose damage ahead of time?

did he explain the label damage?

Doesn’t seem too bad to me overall, but I’d consider emailing Cgc to get an idea of what to look for.

other than the slight damage to a case from 2013 what possible reason(s) in your mind would there be for this slab to have been cracked open and replaced by either the same or different X101 book signed by both Lee and Claremont??
 

seems like the most probable answer is general wear and tear to the slab from handling over time or damage from shipping

seems like you have a line of communication with the seller so I would just flat out ask if he/she were aware of the damage, if they were the original owner and knew how it came to be, or if it wasn’t there prior to them shipping to you (if that is how the transaction took place)

If he didn't mention the damage and you are not happy with it, return it.  When spending that sort of money, your satisfaction is paramount.
