ERROR IN THE LISTING

I know that this has been discussed before, but.....

 

If a seller makes a mistake in their listing(BIN rather than opening bid), and a buyer uses the BIN before the auction is cancelled.....

I did with an FF #4 that was an obvious mistake, I did it to save his bacon and he thanked me and relisted with an extra zero. grin.gif

 

In a scenario like this, the seller has no obligation to honor the sale, and I believe EBay backs the seller as well on eroneous BIN entries.

Here's an Email I got from the seller.....

 

"Thank you for your winning bid. We are terribly sorry for this inconvenience

but due to circumstances beyond our control there was an error in our

listing format by one of our employees. Because of his error, all of our CGC

auctions were listed as fixed price listings instead of actual auctions with

a starting bid of $9.88 and no reserve. As a result you purchased one or

more of our eBay auctions. These books were purchased and submitted at San

Diego Comic Con and we just received them the other day. We have incurred

huge expenses traveling to the show and we hope you can

understand the losses that we will take if these auctions were to be sold at

these prices. The employee that made these errors will be reprimanded by

management, and although we do not expect you to forgive us of this mistake

we humbly ask that you allow us to relist the auction(s) and chalk this up

as a bad experience. We are proud of our 10,000+ feedback status and

Platinum Powersellers status, which is why if you still would like to

complete this purchase, there will be no hard feelings and we will gladly

process and ship your order as soon as payment is received. We apologize for

any inconveniences that this has caused and we look forward to your reply."

Ask for credit and make them leave you good feedback anyway

They did offer to process the order at the winning bid price !!

You could have held them to it, but they most likely would remenber you down the line & it may effect possible purchases later. So , I think JC got it right. A raw book or two would save face for all concerned !! grin.gif

OK - Joe - I will announce this publicly. I hope you don't decide to leave again for two reasons: the first is that you make for replies for me that make me think (I really LOVE thinking) and you also have some solid ideas. But we definitely see eye to nose on many topics. but that is not a bad thing.

 

So - just as an aside - stick around - continue to post your ideals. I shall do the same. An environment that does not allow both is an environment that would suffocate me in minutes.

 

And I STILL want replies to my pointed questions! If you have not retained them let me know and I will repost them.

PS - oh yeah - the despised Medved Brothers claim Lugosi said, regarding LOBO(Tor Johnson) in BRIDE OF THE MONSTER "He's gentle as a kitchen!" Well, if you view the dvd or vhs you will see that Lugosi distinctly said "kitchen", not "kitten". Yet another sham that is oft' repeated by the uninformed.
