I did pay for it. After he refunded my money and told me to keep the book, I sent him $10.

The $10 is a nice gesture. It really isn't "payment".

 

If you do consider it payment, and the guy obviously has offered you a refund on the item, then since you paid for it (and chose not to refund the item), then what are you complaining about? You were given the choice to get your money back, but chose not to.

 

So no, the $10 was a gesture, not actual payment.
