Color break line on back but it's 9.8?

I just got this Batman 635 from ebay graded as a 9.8 but I look over the back and am wondering how it received a 9.8?

I mean isn't this an easy 9.6 or does it depend on the book also?

Granted the book looks pretty good everywhere else and I don't see stress lines on the front but it's not tiny.

Because of the camera flash glare, it's difficult to ascertain what's actually there and what's a flash. However, if I think I see what you are referring to it is a large tear. If CGC sees this same tear on all copies, it will sometimes get a 'bindery' pass.  To me, a flaw is a flaw, a tear is a tear, and this is not a 9.8 . I would not be happy with this book. If all copies have the tear, then why not simply own it raw ? Why pay a premium for a 9.8 with obvious flaws ?
