    I realize that. You, however pointed to it as "proof" a transaction occurred. My point is that something that happens only in private between two people isn't proof to anyone else.

    Branget made an error in informing the buyer of availability and moved to correct that error. To his credit, Branget gave the buyer an option to rescind the contract for sale at that time, given the new information.

     

    When the buyer, given all the necessary and new information on the 6th decided to continue the agreement he, in effect, created a new agreement for sale, one that he freely agreed to.

     

    The time for rescission was at the time Branget offered it as an option. Once the buyer freely decided to continue with the transaction at that point both parties were bound to perform. Branget relied on the payment and on the buyer's word that he would perform as promised.

     

    All this is probably true, but we don't know any of it. We believe it because we believe branget. We don't know it because it was done privately.

     

     

    Finally, I think you are mistaken about the purpose of the probation list. It is for ALL BOARD transaction, not for public board transaction, or sale thread transactions. It is for all transactions initiated on this board and through this board. A transaction created out of a WTB Thread has just as much a proper place on the probation list as a sales thread issue.

     

    My concern isn't that the transaction came from a WTB thread -- it didn't. The buyer has in fact only posted in 2 threads ever, 1 WTB thread and branget didn't post in it. My concern is that the transaction occurred entirely via Private Message.

     

    That's my issue here is there's no public indication at all between the "buyer" and the "seller" of this transaction. Now the buyer's on the probation list over a sale we all believe happened.

     

    I'm saying this is messy, and if people want community support and assistance (i.e. bad sellers/buyers going on the probation list) then there ought to be some community indication of the sale in the first place.

  4. OK Snake Eyes I see what you're saying. No point in letting the whole community get burned. But, branget does admit to a pretty serious mistake in not identifying this as a pre-sale up front. Buyer may be a flake, but the thing about terms changing isn't 100% untrue.

     

    Sorry branget if I seem tough on you about this. Just the Prob. list being used for non-public sales seems a bit off to me so I needed to work it through.

  5. I recently had a newbie that posted in the WTB thread contact me. We worked out a deal. He paid on the 6th and demanded a refund (including filing a paypal case) on the 10th. This was a presale of items arriving back from CGC. Is this an appropraite transaction to recommend he be put on the probation list?

     

    Can the mods read PMs to confirm sales agreements through PMs? I don't want to question anyone's honesty, but we are talking about putting someone on the probation list without any public evidence that an agreement of a sale even existed. Branget's been around a long time, but this does introduce the possiblity for the probation list to be abused.

     

     

    The only part I feel I could have improved is making the Presale known sooner in the transaction.

     

    Did you let him know this was a Presale before he sent the funds, or after?

     

     

     

     

  6. I appreciate being paid via Paypal personal, but it is not a sales requirement. I really don't understand why it's such bid deal. I'm certainly not blood over it.

     

    It's only a big deal if you insist on the personal payment method. If you don't, it isn't.

     

     

    Some people say that there's no paypal buyer protections for non-ebay purchases. That's not true. The buyer complaint process applies to non-ebay purchases. Except that "You may not file a dispute for a Personal Payment."

     

    Even if you use a credit card to fund the purchase, the buyer isn't necessarily protected by credit card protections since they indicated that they weren't buying a "good or service". Sure they really did, but according to the official payment slip (in this case the online form) they indicated "this is not a physical good or a service" and therefore not technically protected by credit card chargeback either. How that works out in reality depends on the credit card company.

     

    It's also lying, and frankly some people have a problem with that. And given that PayPal sales are reported to the IRS, it's a kind of tax lying. Or it uncomfortably feels that way.
