  1. I'm a little concerned about the president this sets though. When a buyer pays me via PayPal I never actually open the payment e-mail I receive and read it. I just see the e-mail in my In Box, know that payment has been made, and begin preping the item for shipment. I would assume many sellers, if not most, do thee same. But the above makes it sounds like the seller, by accepting the PayPal payment, binds himself to whatever conditions the buyer stipulates in the comment section. In effect, the payment becomes part of the transaction negotiations. So is it incumbent on the seller to open and read those payment e-mail to make sure the buyer hasn't unilaterally changed the terms of the transaction? Not commenting on this specific situation so much as asking in a general sense. Yeah, I totally see what you're saying. But, PayPal is going to place heavy emphasis on the invoice, since it is essentially the sales contract. I've found it's usually best to send a payment invoice with an accurate product description, rather than rely on whatever the buyer sends in to avoid this problem. This is not to say that PayPal wouldn't investigate all communication, including the advertisement, but it's taking a chance. In this case, I wasn't commenting on PayPal requirements so much as pointing out a way to manage buyer expectations to avoid the kind of problems we're seeing here with this transaction.

  3. A-donis. Could you answer this question? This is the first indication that the customer is expecting something that you can't provide and there's a problem. No, the first indication was a PM dated 10/15/2014. Justin wrote "Is there any update on this? Did it get signed and Pre-screened as a 9.8? Thanks!!" A-Donis wrote back an hour later saying "All books were signed and subbed." The first time he mentioned that the grade was up to CGC was on 11/12 when he said "Some are graded, some are scheduled for grading. But won't know grades until CGC ships them." That was what caused Justin to write the PM I quoted earlier "Wait, I'm still guaranteed a 9.8 right?". In my mind, there is no question that A-donis implied a 9.8. Had he not, he would have corrected Justin and said, "hey FYI they were signed and subbed but were not pre-screened (*or couldn't be pre-screened, I'm not sure if you're allowed to pre-screen SS*) and might come back lower. I did my best to get them all 9.8 but I sold these with no guarantee." IMO the first indication was the sales invoice. The buyer clearly stated 9.8, not whatever grade comes back. If this was not what the seller meant, then I think it would have been best if the buyer's expectations were adjusted at that point, or his payment returned.

  9. I sometimes fail to do that. Best practice is to let the sellers know. But I definitely fail sometimes. In fact, a lot of times, it is a week or 10 days before I even open stuff. I rarely do. Also, as a seller I just assume no news (within a reasonable amount of time, say within a few days of when the package should arrive) is good news. If it's an eBay transaction, I usually don't send a separate message. I just leave good feedback. If it's through PayPal, I almost always do - especially if it's an expensive book. I've been in the seller's shoes and know how nerve-wracking it can be to wait for word.

You have to set the cups up again after every try and you have the unpredictability of the cat to consider How many times in a row will the cat fall for that? I think the cat's in on it. He stops right on the mat and hunkers down.
  12. Many of the questions raised in this thread were addressed in the original query. Short answer: No. The qualifiers being that general perception here is that it's 9.8's or bust w/modern presales & the sales forum guideline require a grade/scan. So if the buyer admits to assuming the grade - how does everyone feel about his Paypal action? If he's refused the return/refund route I don't agree with the attempt to seek a refund through Paypal arbitration and keep the book. PayPal will make the refund contingent upon the return of the book. They will probably even send a shipping label for him to use. He can't get a refund AND keep the book.
  13. I'd agree with that IF he looked at the receipt and read the note carefully, which in fairness he may well not have. I guess I'm coming at this from a Seller's perspective. It's in the seller's best interest to send invoices that clearly state the item description. And in the absence of a seller invoice, if the seller accepts payments with buyer descriptions, then it's incumbent upon the seller to make sure they are accurate or they risk getting the item returned on their dime.

LINK When he sent the payment, he made a notation for a CGC SS 9.8 - Which was pointed out after the books were subbed to CGC from NYCC CGC grades the books, the copy comes back a 9.6, which seller provides via invoice number. Buyer wants refund, seller will honor refund at a 100% of bought price. Buyer the escalates paypal dispute to a claim, where paypal is currently reviewing, not allowing me to continue with the refund portion. It begs the question though, of why you would accept payment for a 9.8 if no grade expectations were given. Under these circumstances, I would expect a seller to push back and state that they could not accept payment with an invoice the incorrectly describes the item as a 9.8. This effectively sets the seller up for a SNAD case if anything other than 9.8 is shipped. Doesn't make much sense.
