Is that true? I thought CGC changed its policy to overlook the tape and grade based upon the defect that the tape is covering up (e.g., if its holding a tear together they deduct for the tear, not the tape).

Overstreet which has been around a lot longer than CGC clearly states it is not allowed for a 9.8. Actually, color breaking spine stresses aren't even allowed in 9.6's.
CGC deliberately doesn't give clear guidance on their grading standards so they can get away with this. I bet you if I cracked this slab and submitted in 10 times it wouldn't get a 9.8. It only got a 9.8 because of the submitter. One of CGC's largest customers.

There is still hope. Case in point - I ordered a propane heater for my Vanagon last June (2021). Shipper sent via UPS. I got notification that it was delivered so I went outside to retrieve the package but there was no package there. Contacted UPS and they said shipper (not me) has to open investigation. Contacted shipper and they opened one. UPS called me to confirm. Case was opened and closed 5 times and only the shipper, not receiver (i.e., me) could re-open. Shipper had great customer service rep who was relentless and got UPS to pay them full value. Shipper then sent me a replacement heater. All was good from my and shipper's perspective. Yesterday, I'm sitting on the front porch and up walks the UPS guy with a box. Guess what it was - the original heater. 9 months later.

Don’t have an answer but do have an observation. When you search some past sales there is a note about the 15% BP will be added to hammer. That makes me think it is not added and thus not reflected until the sale is final ie buyer pays.
