  1. I can see I'm wasting my time. Do whatever you need to do, as I'm no longer interested. I didn't accept the invoice, the item never stopped being on sale, and I've wasted too much time making my case to a union of friends. Good day.
  2. But he never ended the sale on eBay. If it's still available for sale to the public for 12+ hours after he sends an invoice, it can't exactly be sold to me now can it?
  3. Anyone can send unsigned contracts out to whomever all day long, but if they're not accepted/signed/etc...they mean nothing.Verbals mean nothing when no transaction takes place. Again, the eBay sale never ended, the book was never sold to me, I never agreed to the PayPal invoice. Payment due when services rendered. It's clear as day.
  4. I didn't win a bid. We discussed numbers, I asked for an invoice, but never accepted it. The book was never sold to me.
  5. And on "this board," I did actually pay for the book that I said "I'll take" when I sent money to Hulk. Again, had I known that Court was a member here and that his eBay OFFER would mean the same thing, I would have done things differently.
  6. Again, using your example, I never signed the contract. If I had accepted the PayPal invoice only to then cancel it, THEN there might be a contract issue there to be upset about. But I never accepted his PayPal invoice, no money was sent, no book was ever sold to me, thus no deal was formally struck. I work in contracts all day long.
  7. The eBay transaction was never completed. That's my point. I found a better offer before I made the purchase, and I acted on it. Does that mean you accepted the counter offer, but didn't finish the Paypal checkout? No. There was no formal acceptance via eBay. I never accepted the PayPal invoice because the book was still listed for sale on eBay many hours after I asked for an invoice, I assumed the deal wasn't officially done.

  9. I didn't ever buy Court's book. Big difference. Using your example, I was in line at the checkout at Best Buy, but I decided to put the TV back on the shelf and buy elsewhere. As a consumer, that's my right to do so. All this boils down to is sour grapes. Court is upset that his sale went elsewhere, and he's burning me on these boards because of it.
  10. The book (listed as a "last one") was still a "buy now" sale on EBay for 12+ hours time after I received the invoice. At what point does the seller acknowledge a "locked-in" deal and remove it so others can't buy the last one? Both Court and I are at fault for not pulling the trigger. If he had ended the Ebay sale after I asked for the invoice (he had a long time to do so but never did), none of this would have happened.

After putting my name and Ebay handle on here, as well as asking that people ban me on EBay simply because I wasn't aware of prior friendships between sellers and I simply found a better deal before money changed hands, I don't think I will give him my money. If that means not buying on this board, so be it.

Rule 1 © c) The 30-day rule is suspended if the accused refuses to complete the transaction or if the transaction cannot be completed due to, for example, the item being sold to someone else. Then burn the witch! We still need to be clear as to whether or not he was a board member at the time, and that it wasn't just from e-bay. And wouldn't the newbie have a case for putting Hulk44 on the list for refusing to sell the book he paid for? I was not a board member when I asked Court for the PayPal invoice from the Ebay offer. I had no clue that Court was a member of these boards. If I did, none of this would have happened. I saw Hulk's offer on the boards, as it's free to read without registration, and his mention that he had a very expensive book on Ebay. I got on Ebay, found the book and Hulk's Ebay handle, and messaged Hulk via Ebay about getting registered for these boards and claiming/buying his cheaper book.
  13. Here's the deal. He offered a single book for $999 on Ebay. I negotiated it down to $800. I asked for an invoice last night, he worded it incorrectly, and I asked for a corrected version which he sent over this morning. The book's availability never left Ebay though, 12+ hours after I asked for the invoice. It was still available for purchase at noon today when I made one last look to make sure it was the one I wanted. Anyone could have bought it at the "buy now" price Court had it listed at. I happened to find a cheaper one on here, and of course not knowing or thinking that there was such a close bond shared between the two sellers and that a stink would be raised, I asked Hulk via Ebay to help me get registered on the boards so I could claim it. I canceled the original Ebay invoice because I found what I was looking for. I claimed Hulk's book and paid for it. I get that Court is upset that the sell went elsewhere. I'm new to this site and wasn't aware that it would come full circle. I just wanted a $700/$800 book at the better price, as any consumer would. If Court had pulled it from Ebay (it was listed as the "last one"), and set it aside for me, I would never have canceled the PayPal invoice and bought from Hulk. Do what you will, ban/probation/whatever. This has all gotten far sillier than it ever needed to get.
