Ebay killed my listing! (for circumventing fees). Apparently you're not allowed to charge 2% for Paypal fees on expensive items. I have one $4500 offer that might TANK because eBay cancelled my item! :(

Contact him directly and save the fees. :P

 

And it's against the law for sur-charges on credit cards or Paypal.

Could you please provide the state or federal statute proscribing such fees on cc's or pp (merchant services) purchases?

 

You gotta support this statement with some law if you're going to throw it out here like this...

Under Visa, MasterCard, Discover and American Express regulations and the laws of several states, including California, merchants may not charge a fee to the buyer for accepting credit card payments (often called a "surcharge"). You agree that you will not impose a surcharge or any other fee for accepting PayPal as payment. This restriction does not prevent you from imposing a handling fee in connection with the sale of goods or services, as long as the handling fee does not operate as a surcharge (in other words, the handling fee for transactions paid through PayPal may not be higher than the handling fee for transactions paid through other payment methods). Nor does this restriction apply to Pound-denominated transactions by sellers residing in the United Kingdom listing items for sale on a UK-based website.

There is a reputable dealer/seller on the boards who shall go unnamed by Tupenny this post-eclipse of the moon evening who engages in such surcharges. I had never objected to them as I figure paypal is just another codified & legalized form of graft & a deal is a deal, arm's length transaction & all of that. But this changes everything. CALIFORNIA & several, eh hem, unnamed States say so!!

Man, can't people form their own contracts without California, the Virgin Islands and Guam saying NO!!

I personally don't mind paying a surcharge. This is especially helpful at conventions. I haggle, offer to pay the 3% credit card surcharge and the dealers wet themselves with joy. :)

I know that here in NY State if a gas station or restaurant (etc...) issues a sur-charge for CCs they're breaking the law.

 

The CC companys and the banks that issue them got those laws past in almost every state due to the power ($$$) they have.

 

Since Paypal takes CCs (credit cards) I assume those laws apply to anyone using Paypal, unless (maybe) they have a free account without any CCs.

 

However if the buyer agrees to pick up the fee then it's part of the deal I guess.
