Doctor Strange 28, Iron Man 1

Need some input from the boardies, please

 

1) The Doctor Strange 28 looks at least 9.4 but the bottom staple is cleanly popped thru the cover. How would CGC grade it with that problem?

 

2) Top edge of Iron Man 1 is not ruler straight. Could that be most likely from the printers or from trimming?
