Compare that photo with the example shown below. Notice the bits of red blotches in some areas of the black field, where the one on Ebay is completely black.

Why is the one on Ebay different?

 

Edit: Also notice there is no partial lettering showing of the Marvel logo on the Ebay copy, which is also different.

The error book is a result of the failure of the red foil to adhere to the book properly. As you have noted there are some with red flecks showing a partial adherence. There have been some intimations that if you can get the red foil hot enough, you can "make" an error book. Boardies have tried and failed. I consider them all suspect at this point.
