Anyway, I wonder what would happen if he ended the auction early and took the high bidder to court if he couldnt come up with the 100 million dollars.. bidding is a legally binding contract right?

Probably not, without some defined consideration flowing from the seller. But it would be funny to see them duke it out in court!
