DC Comics drinks Batmobile maker's milkshake

Really something like this actually helps DC as it keeps their characters in the public eye and DC is not selling Batmobiles so it's not like they are in any way financially damaged.

its not just about financial damages, its about control of the IP. It's DC's IP to decide what to do with it. They cant control the quality or any other factor of some independent company, so that companies product could adversely affect the perception of their "bat-brand".

 

thus the ruling.

No. More like if Ford wanted to make a real Batmobile and pay DC to do so, the copyright would not be valid because they didn't vigorously defend their copyright. Thus in order to protect it for possible future use, you have to go after everyone.

That makes even more sense

 

Yea it's kind of a drag. I've had clients come to me and ask to do it in the nicest way possible, but you have to go after everyone infringing on your copyright.

 

Very much why the Mouse and Lucasfilm (before the Mouse) did the same.
