  1. A suggestion that some of your statements are unwise or immature is not name calling or an ad hominem. It is a criticism of your statements. The statement above, for example, seems terribly unwise because it speculates about the emotions of people you've never met and don't know, and it also ascribes a heroic attribute (the "Man Without Fear") to a behavior which is far from heroic (endangering others by violating the stay at home orders). I feel free to say my mind on this site because I don't make my living off of comic books. The dealers on the site generally, with some exceptions, tend to guard their words better than me because they don't want to offend a customer. It is not at all uncommon for folks to refuse to do business with people they decide they don't like. So I can't fault the dealers for wisely trying to preserve their customer base.
  2. It's amazing how much you can do remotely. So far it's been motion hearings, appellate arguments, and even mediations. But, discovery is obviously much more difficult. The courts don't want to grind to a hault, but they are going to be open to long schedules.
  3. My law firm has a large UK presence. I get frequent bulletins on what is happening there. I thought QE2 nailed her address, and the applause for health care workers was very inspiring. The Brits appear to be confronting this crisis as they have many worse crises in living memory (Dunkirk, the Blitz, etc.), with their typical calm and reasoned reserve. Over here, the populace does not have the family history and role models that are quite common in Britain. We are much more insulated from the World. I am proud of how my city, San Francisco, is handling the crisis and I think it has clearly helped.

  5. Think is guilt if the jury is the one who thinks that. Computer records are absolutely subject to disclosure in civil and criminal litigation. I get or produce them in almost every case I litigate.

  7. I'm an attorney. And for civil liability the starndard is "more likely than not" or "preponderance of the evidence," and "beyond a reasonable doubt" is not that hard to prove. Our jails and prisons are full.

  9. I think it is a safe assumption that everyone knows today that they could potentially be a COVID-19 carrier. That is the entire rationale behind stay at home orders, and that's what the media and the government have been explaining for weeks. I do not think that a "bury your head in the sand" defense would fly with jurors where I live.
  10. Based on my litigation experience, I would conclude that in today's media environment, it would be next to impossible to fail to prove a "knowing" violation of a stay at home order. I also think it would be hard not to get a jury pre-disposed against people who disobeyed orders that the jury respected.
  11. The action (having sex with someone) has to be deliberate, you do not have to intend to spread the disease to face civil or criminal liability.
  12. You know you potentially have COVID. The government stay at home is designed to prevent social spread by folks who are "silent carriers." By knowingly disobeying stay at home orders to do "D2D," which I infer is "door to door", you are knowingly risking spreading the disease. If you test positive at a later date, yes, you could find yourself in some legal or civil hot water. More importantly, there's a moral implication which apparently does not matter to you.
  13. A person's right to throw a punch ends before it hits another person's face. You got a STD, and you have sex with someone without telling them before hand and give them the disease, then you face civil liability and jail time. You violate lawful government stay at home orders and you potentially face the same consequences. Them's the facts.
  14. I think you mean tens of thousands or many more. The economic devastation, worldwide, from this crisis is unprecedented. We'll bounce back, but a lot of people will suffer. I already know people who have lost their jobs (at least until their employers re-open). But, if Pesident Trump is right that we are now facing 100,000 to 250,000 deaths, on a good result, than I can't fault any governor for trying to save lives.

  17. I haven't shopped for masks, but I am sure they too are being directed to health care workers.
  18. That phase passes. The only thing completely unavailable in SF are cleaning wipes, which are now deemed as a priority item to be sold to health care businesses first.

Essential businesses are largely limited to health care providers, grocery stores, take out food vendors, delivery drivers, lawyers, doctors, media, car repair, gas stations, and in some states gun shops. Most responsible businesses have workers working remotely if they can. In 911 the heroes were fire fighters. In Covid-19 the heroes are grocery stores clerks and hospital workers. They are getting paid minimum wage to be on the front line of exposure. The grocery store clerks are making minimum wage.
