Both GPA and GoCollect reference Ebay sales for their respective assessments of FMV, so I am not sure how you arrived at CGC providing and offering a valuation of 110% with taxes of current Ebay prices

Based on GPA, I would say the delta between their FMV estimate and CGC's is roughly 40% to 50%, which is still under what I paid for the books considering market value at the time, shipping costs, buyers premium, etc. However, I have attached a screenshot for you to make your own assessment. I, too, recently received emails for three of my four books affected by the tampering incident. It appears based on the offers provided by CGC that their analysis or assessment of "fair market value" is the actual or true grade of the book as part of this incident, not the grade as noted on the holder or as the consumer and original purchaser believed the book to be, which to me as someone impacted is unacceptable and in no way an attempt to make me whole. CGC seems to be playing with words such as "fair market value" to shroud their intent to make minimal disbursements for the claims in this incident.

Outside of the validation of the certification number via the CGC verification site, CGC does not provide or outline any procedure or guidance for the consumer to inspect and discern or detect if the CGC holder or the contents within the holder have been tampered with, counterfeited or the contents of the book within the holder are in any way incomplete. Prior to this tampering incident, there wasn't even any statement regarding how a consumer or purchaser should take action if they suspected tamper or the contents of the holder had been altered in any way. The consumer or purchaser was standing on CGC's guarantee that the contents of the holder were authentic and unaltered based on the conveyance and trust of CGC's grading, holder and certification process.

The answer is yes that is correct to your questions on all accords. As well as the additional issue of the response I received from CGC of how they are addressing books that have been potentially tampered with, which were purchased directly from Mr. Zanello, but not included on the list as part in their announcement of the incident.

As one of those impacted, I can answer questions 1) and 2), based on the response I received from CGC. To question 1.) To my knowledge, the answer is Yes, the book has been surrendered and will be retained by CGC. With regards to question 2.) I am just getting back in to collecting and only been back in the hobby about 6 months. However, personally, I wouldn't and don't want any books that were in the hands of the individual executing this fraud. There are actually a couple of books on ComicLink, while not the list, that are from his submissions and it has that fact alone has deterred me from entertaining bidding on them as we still don't fully know all the facets of his nefarious and fraudulent activities.

It does appear something has changed in their plan. This book which is struck through and has a new grade date is available on Heritage for sale. Being one of those impacted by this incident and fraud, I align with mrd160 as well as others who have commented and lent their countless effort and assistance in this whole debacle that any book that this individual came in contact with or crossed his hands should be listed for a thorough review with extreme prejudice and scrutiny in said review.

Based on what I have read in this thread and understand so far regarding the fraud and deception that are being used to execute this scam, my concern is that the ASM 238s I purchased are possibly either green label qualified books that do not contain the tattoos or have had the tattoos married to the book to create the ASM 238 Newsstands containing the tattoos, Not sure sure if the books used are truly 9.8s of some variation of the books I just mentioned as after he creates them and sends it to CGC the scans of his created 9.8 are what show up on CGC site when you query the certification number on the CGC cert verification website

If that is the protocol or procedure that Ebay uses to handle these situations, then I guess it is best for me to use the pre-printed shipping label they provided so that Ebay can track and verify the return shipments were delivered. Understanding that I can not add services using the pre-printed shipping label, it means I will not be able to add a signature requirement or insurance. Is it possible that Ebay has already insured the return shipments for the appropriate valuation of each book/purchase?

I had factored in the possibility that after receiving the books back, he may attempt not to refund me for the books by conveying to Ebay that the books were not received back in the same condition that they were shipped and was planning to take pictures prior to shipping the books back, if returning them is the way I decided to proceed. I was also planning to contact the credit card company I used to purchase the books and file a dispute and fraud claim as an extra layer of protection. Alternatively, as I still believe Ebay is unaware that this is fraud, I had thought of just filing a fraud/dispute claim with my credit card company, letting them work directly with Ebay, instruct me where to forward the books to and have them refund me under fraud protections. I never considered him keeping the money as a win, though. Ebay provide me a pre-printed shipping label to return the books via USPS Priority Mail to a P.O. Box address. I thought about adding an additional signature requirement to the shipment as that would require identification and a signature at the post office counter. I hadn't considered insurance on the shipment that would be and is a necessary addition to the return shipment. I am not sure what sending it Registered Mail adds or provides. Could you educate or provide me context?

You are correct. Brees is the name used in shipping of the books. However, in a conversation, I had with briva3. I was told that this individual is someone he has a relationship with. He identified himself by another name during the course of that conversation. However, the recent information I received from Ebay for the return of the ASM 238 books identifies him by another name.

I became aware of this scam via the negative feedback left on briva3 Ebay seller account and the podcast provided by West Coast Davengers and 9.9 Newsstand. I also believe the New Mutants 98 book that was part of the New Mutants Mark Jewler scam that was discussed in one of the podcast is possible a regular Newsstand edition I won in an auction from briva3 prior to the New Mutants Mark Jewelers auction by him. I suspect at last minute he needed the regular NM 98 newsstand as after I successfully won the auction he canceled the purchase through Ebay. There has been a question of briva3 real name, location and possible contact information. Based on the shipments of the ASM 238s, a conversation I had personally with him as well as messages exchanged and most recently information provided to me by Ebay for the return of the ASM 238 books to him, I have contact information for him. In my attempt make a claim with Ebay, I also submitted a return request, as that was the only option available, through their resolution center noting that the seller had been identified as defrauding buyers and that I would like to file a fraud claim. My hope was that using the term fraud would trigger a keyword alert in their system and that someone from Ebay would reach out to me directly. It was to my surprise on Friday that I received a response from Ebay stating that the seller, briva3, had responded and approved my return request for the ASM 238 books. This concerns me as I now don't believe Ebay is aware that this is a case of the seller defrauding buyers and subsequently attempt to take action against the seller. If that is in fact the situation, it ties into my other concern of the books from buyers requesting returns being shipped back to the seller and used later in some new manner to defraud collectors in the future.
