  1. Yes, both books were newsstand variants and the ASM 238 was supposed to be inclusive of the tatooz insert
  2. Both GPA and GoCollect reference Ebay sales for their respective assessments of FMV, so I am not sure how you arrived at CGC providing and offering a valuation of 110% with taxes of current Ebay prices

Based on GPA, I would say the delta between their FMV estimate and CGC's is roughly 40% to 50%, which is still under what I paid for the books considering market value at the time, shipping costs, buyers premium, etc. However, I have attached a screenshot for you to make your own assessment. The books referenced by CGC in the screenshot were both purchased as holdered and believed to be a grade of 9.8
  4. I, too, recently received emails for three of my four books affected by the tampering incident. It appears based on the offers provided by CGC that their analysis or assessment of "fair market value" is the actual or true grade of the book as part of this incident, not the grade as noted on the holder or as the consumer and original purchaser believed the book to be, which to me as someone impacted is unacceptable and in no way an attempt to make me whole. CGC seems to be playing with words such as "fair market value" to shroud their intent to make minimal disbursements for the claims in this incident.

Outside of the validation of the certification number via the CGC verification site, CGC does not provide or outline any procedure or guidance for the consumer to inspect and discern or detect if the CGC holder or the contents within the holder have been tampered with, counterfeited or the contents of the book within the holder are in any way incomplete. Prior to this tampering incident, there wasn't even any statement regarding how a consumer or purchaser should take action if they suspected tamper or the contents of the holder had been altered in any way. The consumer or purchaser was standing on CGC's guarantee that the contents of the holder were authentic and unaltered based on the conveyance and trust of CGC's grading, holder and certification process.
  6. The answer is yes that is correct to your questions on all accords. As well as the additional issue of the response I received from CGC of how they are addressing books that have been potentially tampered with, which were purchased directly from Mr. Zanello, but not included on the list as part in their announcement of the incident.
  7. As one of those impacted, I can answer questions 1) and 2), based on the response I received from CGC. To question 1.) To my knowledge, the answer is Yes, the book has been surrendered and will be retained by CGC. With regards to question 2.) CGC has sighted that this incident is an ongoing investigation and that they do not have a confirmed date for the resolution of the claim. In alignment with the lack of any projected date for claim resolution, CGC has not provided any information regarding valuation or compensation for losses incurred for the books I purchased that were impacted by this incident.
  8. I am just getting back in to collecting and only been back in the hobby about 6 months. However, personally, I wouldn't and don't want any books that were in the hands of the individual executing this fraud. There are actually a couple of books on ComicLink, while not the list, that are from his submissions and it has that fact alone has deterred me from entertaining bidding on them as we still don't fully know all the facets of his nefarious and fraudulent activities.
  9. It does appear something has changed in their plan. This book which is struck through and has a new grade date is available on Heritage for sale.   10. That confirms what I concluded as well. Being one of those impacted by this incident and fraud, I align with mrd160 as well as others who have commented and lent their countless effort and assistance in this whole debacle that any book that this individual came in contact with or crossed his hands should be listed for a thorough review with extreme prejudice and scrutiny in said review.

Based on what I have read in this thread and understand so far regarding the fraud and deception that are being used to execute this scam, my concern is that the ASM 238s I purchased are possibly either green label qualified books that do not contain the tattoos or have had the tattoos married to the book to create the ASM 238 Newsstands containing the tattoos, Not sure sure if the books used are truly 9.8s of some variation of the books I just mentioned as after he creates them and sends it to CGC the scans of his created 9.8 are what show up on CGC site when you query the certification number on the CGC cert verification website
