  2. Thanks all! PayPal account was flush so no CC help. I will try talking to PP to see if they can assist. I'm not crying in my Cheerios. I chalk it up to a lesson learned. Just hope the PL addition helps the next boardie that comes across this doosh. Wonder whether this is HOS worthy. @columbia comics - happy festivus! It's the summer of George! Thanks for all of the advice and comments everyone.

  4. He apologized and agreed on the return/refund so I don't think he will claim that, but who knows. No idea. I don't think he checks PMs, which is why I made the PP claim. Pretty sure that's what prompted his reply. He did give me his phone number and said that was the best way to contact him, but I wanted a record from the outset. He did reply to texts at least on Monday. Nothing since then. I will text and PM the link to the nomination. I have a bad feeling as well. Frankly, I don't think he's a scammer b/c he did ship the book and did communicate albeit sparsely. Regardless, it is weak sauce, bad form and I am out both book and $.

  7. I would like to make my first nomination to the PL. Hitmonchan1 June 14: I purchased a raw Batman 189 described as VF June 20: received the book. Packaging was fine. However, upon inspection I found the CF detached from the bottom staple and nearly detached from the top staple. June 20: notified Seller and asked if he would refund in full. Seller said he would get it taken care of. Seller asked for more pics and whether I wanted a full or partial refund. He also instructed not to send the book back yet as he was out of the country. June 21: I sent more pics and explained that I wasn't interested in a partial refund. June 23: Seller requests I hold the book until he gets back to the states. I agree. After June 23, I sent several PMs with no reply. July 21: I file a SNAD claim with Paypal July 22: Seller apologized and said he forgot but noticed his PayPal acct was negative because of my claim. He assured me of a full refund upon receipt of book. He asked if I could close the claim so he could sell some items on eBay. I complied. July 28: tracking shows book delivered. More PMs from me to no avail. July 29: I Pmd and alerted Seller that I was going to nominate him for PL or HOS. August 1: I texted inquiring as to refund status. seller replied that he had to check with girlfriend to make sure book arrived, and that he would refund me by noon. I told him that tracking shows delivered. August 2: my texts not replied to and no refund. So here we are. My fault for closing the PP claim, but he did respond albeit intermittently and seemed on the level. Not a ton of $ involved ($300 and change), but still.
  8. never? often wise words, but, for example, if i hear from a majority of people that a certain restaurant sucks, i'll probably not visit it, because my eat-out dollar can be spent at so many established places down here in s. la.. i don't see the entertainment dollar as being much different. but i will go see s squad, because i'm a comic geek who sees almost all new comic releases. i sure don't have much in the way of expectations, tho'. Hardly ever And this was in the context of movies, not food. Completely different, but I agree on that point. But I will not let someone dictate what art to like or not. And yes, never on that.

  10. Not to sound harsh, but plenty of people have tried to answer this. Its just not the answer you want. Keep in mind this is just a message board. Sounds like you might be better served talking to a lawyer if you really want peace of mind as far as what your legal rights are. I've spoken with lawyers, but they don't know the extent of my rights in this specific situation. All of you guys here, even those who feel my situation is bleak, have been tremendously helpful. I just haven't seen, or been able to find on my end, any laws or statutes stating that I won't be afforded the protection of criminal investigation. I'd like to again, thank everyone for their support and feedback. That's not how the law works. You can pursue civil remedies, but as for forcing a criminal investigation, I'm afraid it's not worth the prosecutor's or the police department's time. $4,000 is a lot of money for sure, but I seriously doubt you get anywhere on the criminal side against FedEx.

  14. Looks like predator 3 sold for $25 in 9.4 and $56 in 9.6. Am I looking at the right book? Is this all about $3? Not judging or taking sides
  15. Maybe, but he didn't fix it. Easy enough to send a $30 check or use Paypal balance, or reload PayPal and to satisfy the obligation, then straighten things out with the credit card company later.
