Oh, I got it out of my system when he tried his "investment" scheme back in 2010, but since the rule change to include ALL transactions, it's worth a shot to try it here. ;)

His friends (I'm not calling anyone old boys, but he had supporters) all jumped in, said how great he was and he was now off the list. I was not exactly thrilled with the way this went down, but there was nothing I could do.

 

He wound up back ON the list in the Hall of Shame, which did not surprise me.

 

Being a member in good standing here, is not a right, it's a privilege.

Oh, by the way....

 

Since the rules now apply to ANY transaction regardless of venue, I'd like to nominate Dekuekelare or whatever his name is.

 

In Jan, 2009, he won a Batman #428 CGC 9.8 from me on ebay for $405. I shipped the book out to him via Free Media Mail (his choice.) When he received the book, he complained about the CGC grade, in particular that they had graded it a 9.8 with a tiny loose (not detached) chip in the BRC, common on these books. He claimed it had been damaged after the fact. I assured him that I knew exactly what he was talking about, that it was, in fact, NOT damaged, but that if he wasn't happy with CGC's grade, he should send it back. On the off chance that it WAS damaged (though what he was describing was not), it was fully insured, as always.

 

Instead of paying for return shipping, as he should have done, he took the book and the box it was shipped in back to the post office several days later (4 or 6, it's recorded somewhere else on these boards) and, in contravention to USPS regulations, "refused" the box so he could send it back for free. USPS regulations state that an item must be UNOPENED to qualify for refusal.

 

The box then got lost in the USPS system. Obviously, the USPS doesn't care much for Refused Media Mail.

 

After it had been lost in the mail for a month, "Dekeuk" wrote me and threatened me, stating that if I didn't pay him back his money...despite me having clearly NOT received the item back yet...he would file a Paypal claim...and that is precisely what he did. To date, that remains my first, last, and only charge-back EVER intitiated against me in 11+ years with Paypal. I have never in my life heard of a company refunding someone before they received the product back. Paypal ripped the money out of my account, and I was foced to cover it...even though, again, I had not received the item back, and proper protocol is to wait and file an insurance claim against loss.

 

He didn't like CGC's grading, which has nothing to do with me. He couldn't be bothered to pay for return shipping. He broke USPS regulations in returning the book. He filed a Paypal claim against me, even though it was HIS fault the book hadn't shown up back to me.

 

It eventually showed up a couple months down the road, but the damage had been long done. I had been timing the market, and after 3-4 more months, the value of the book had nearly halved, so I was only able to get $250 out of it. The subsequent buyer was quite pleased with the book and its grade.

 

In my mind, "Dekeuk" still owes me the difference, especially for the grief and damage to my Paypal reputation he put me through.

 

Dekeuk was later involved in an investment scheme on these boards, and disappeared entirely when called on it.

 

This is way too whiny, and really not the point of the list at all. :grin:

If you dont want the books I will refund your damed money, I am not so hard up that it makes a world of difference. Its ridiculous to em just as much as you. I have never had any issues on these boards, and hopefully never do again. If you really dont want the books don't take them.

 

But do NOT make me sound some whiny little girl, I contacted you NUMEROUS times and got no response. It is frikkin rude, and a waste of my time. I will have you removed, but honestly I feel like not doing it out of spite. You really pizzed me off now, do not ever act like I have been anything other then nice to you. I have had the books sitting here for months, and I just finally saw you post again.

To be honest the conversations on both sides have been near unintelligble. Too much anger and too wordy. No one has just laid out a simple timeline and responded to it. The "resurrection removed himself from the PM" is odd and I still am not sure to how that fits in the chain.

 

From what I have seen Chunky paid you the $50. You even offered to refund it. You said if he paid that would be the end of it. So how does this sit with you?

 

Its an E-Check and has not cleared. So no, I will not do anything yet.

First of all, didn't chunkybutt (shudder) pay the 50 bucks? That should get him off the list, right? And second, do you see a problem with adding a 48 hour grace period for the issue to be discussed? Everyone always agrees that it's best when these things are worked out, right?

 

I am glad to read this but I am confused because we already HAVE agreed on both a PM and a "reasonable" waiting period for reply to a PM. This is very old news but some folks are acting like it is all a new concept.

 

From the original accusation, the deal went off in February and it was presented to all that multiple attempts were made for contact, therefore the reasonable waiting period had expired long ago. I agree, this is not a new concept.

 

And to recall the original post...

 

Could we add Chunkybutt to the list. I have been holding a stack of books for him since february. I have made contact with him recently, sent a total and he has not responded. I am tired of chasing the guy for the money. I will notify him of this post and allow him to chime in as per the rules. The guy is really nice, I do like him. But leaving me with little to no responses for so long brings me to this.

 

If he completes the sale, I will return and ask him to be removed.

 

I don't believe this last part has been resolved, yet, therefore no removal.

 

well I did complete the transaction, however Resurrection said in his PM to me that he would like to remove me from probation list if I stop slinging Mud. So I guess it is a case of, "You better be quiet and stop proving me wrong or I will make your life miserable" type of situation.

 

secondly I only fell under the criteria of the list (at the time you put me on it) because you believed him and did not hear my side.

 

granted I did owe him money for something I forgot I did.

Eric I do not want to argue, or continue this. We are both grown men (I assume you are over 18), and I am sure we can handle this better. I admit, and will do so publicly that I was offended and lashed out. I have been on good terms with damned close to everyone I have ever dealt with here, and would love to keep it that way. If you did not remember, and needed the issue numbers, that is fine. If you wanted the thread, fine, I have some old PMs but did delete some others. I see no reason why I just wasn't replied to. If I see the other party reads the PM but deosn't reply, I assume they are ignoring me.

 

I have to ask, would you rather hash this out, and be done with it? Or keep slinging mud. I would obviously prefer to wash our hands of the whole situation, shen we had talked in the past you seemed like a nice guy, hence me sending a message asking if everything was ok. It wasn't for money, it was me asking if you were ok.

I was being sarcastic, but lets say it was a AF15 I bought in his sales thread and he waited to total me up (give me his email and shipping charges so I can pay) in the time he waited he sold it to someone else......

just saying that if I was a seller I would contact the buyer via PM at the time I post the "winna" dude with a total and the option to hold the books if he wanted to see if thread was still ongoing, which by the way is what he did the previous two times I bought from him.

It is not a crock of BS I admitted that I did post the "I'll take it" but he jumped the gun tryin to ruin my name because I did not respond fast enough to his threats.

I will repeat it again for you as either you did not read the initial thread or did not comprehend it.

I am sorry but if someone says I owe them money I want to make sure that I do, maybe he made a mistake and thought that I didn't pay for a batch that I already did.

 

But back to the subject at hand, yes, I think that a seller should be more punctual. I have had another transaction recently that I waited nearly a week for a total from the seller

Most of your posts are incredibly difficult to read because you do not use paragraph breaks, capitalization, or punctuation properly.

Now chunkybutt and resurrection have chimed in.

 

I have deleted my Probation List thread that had removed chunkybutt and reposted it with chunkybutt added again, with a notation.

 

The reason for this is that first chunkybutt has had the time to defend himself. But we just found out from resurrection that the payment was via PayPal e-check and is still clearing. So it has not been finalized. So back on the list chunkybutt goes until it has cleared. At this stage it seems that resurrection has the yea/nay on chunkybutt remaining on the PL. That is part of what is being dscussed with the new rules set. But nothing has been finalized there. Hence a grey area.

 

So that is where things stand now.

 

I WILL say this. Both sides had too much jargon/diatribe and not enough simple, hard facts. That is what the PL should be about. Neither side mentioned a paypal echeck until a short time ago.How can that not be seen as important information?

 

If someone comes on here and requests a member be added to the PL, I would expect that topic should be important enough to them for them to say "yes, they sent me a paypal echeck and I am waiting for it to clear" a lot sooner than this.

 

I would similarly expect the sender to say at least "I sent a paypal echeck to cover the transaction".

 

I have not seen either and did some searches. I may be in error here but from what the searches turned up this echeck was never mentioned.

 

What I have seen is a lot of essentially off-topic (for the PL) personal opinions, attacks etc.

 

These just serve to confuse the issue.

 

And if I am wrong in any of the above please point it out and I will acquiesce and apologize (lot of whoop that will do). But when bringing someone to the PL area, and when defending yourself in the PL area, drop the *spoon* and just stick to pure facts.

I must commend you on your patience with dealing with all this. More than I could deal with. Your last recommendation seems fair but if Chunybutt's E-check clears I think he should be removed from the list with or without the approval of Resurection.

I've been on here 5 years and made thousands of $'s worth of purchases and yet have never been put on this list. If my drunken can remain off this list, there is no reason why sober adults can't. You hit the "I'll take it" you fricken pay for it.

I work all weekend, so I may not respond immediately, but I certainly will. Like I said nobody should be on the list unwarranted, and I don't hold grudges like that. I seriously doubt anyone will ever have another issue with Eric. Our past transactions were flawless, it's a shame this whole thing went south.
