Not sure how badly the tear in the back cover hurts this one.

 

Tear is one and a half inches long, about half way down. Inside pages are off-white. There's top overhang on the cover so I don't suspect this book has been trimmed. Just miscut.

3.5 mostly due to foxing and stains on back cover.

I would say 4.0. The tear looks pretty significant. Also as oak mentioned, the foxing and stains, lower it for me, as well.
