Is This Legal?

I have seen a few sellers do this (examples below) but I question whether this is legal or not.

Do "burned" comics from the Golden Age get a "pass" copyright wise? Or would they only if the company is now defunct?

 

I ask b/c I would love to get a run of GA books to read, particularly Planet Comics, but I don't want to do it if it is illegal or unethical.

 

I can't see current comic publishers being too keen on this though.

 

Thoughts?

The only way this is legal is if the source material is in the public domain or if it was purchased legally from the rights holder and this is that selfsame copy that was purchased.

Planet Comics are probably in the public domain. Marvel Team Up? Definitely not.

 

Right, those rights have been renewed for sure.

 

Also, Saga, no way. lol

It would appear to me that the first and third link are illegal. The second (Planet Comics) is legal as those are in the public domain. The third guy claims the Marvel Team-Up run is in the public domain. Technically, that could happen. Realistically, it probably hasn't. I don't have any copies in front of me, but I would be very surprised if it is. To my knowledge, Marvel always used proper copyright notices in their 1970s titles. His other auctions for Marvel product that state they are public domain clearly are not (as would be the case with the Ultimate issues included in the Marvel Team-Up auction).

I mainly just wanted to know if I could maybe get a run of say Planet Comics to read in good conscience.

 

It is amazing how many "bootlegs" of this stuff there is on eBay though...I'm surprised that these guys are not getting "cease and desist" letters...

You can join the Digital Comic Museum (free) and download the Planet run plus anything else on their site. So it's mainly a call between spending your time vs. paying the dvd price to save yourself the hassle.

 

Also, they're set up to read online as well, no downloading required. Just select an issue and click the "Preview" button instead of "Download".

The rights holder has to file a VeRO complaint.

 

They are pretty quick to squash these auctions when they get a VeRO from a rights holder.

 

Short of them contacting Ebay directly? Forget it.

Well technically he's right, selling illegal goods that you buy is still illegal
