I agree. 

There is allot of "stuff" on it. That stuff could be dirt on the bag, glare from the platic or damage to the book. I didn't see any color breaking creases and we have to make the assumption the BC is perfect. Therfore it could be NM and depending on the "stuff", all the way down to a FN. 

Long way of saying hard to tell with what we've got.

yeah - its hard to tell for sure - the only color breaks I see are a couple in the spine - the back looks pretty clean but needs a decent pressing for sure. All those scratches and dings don't really break color as far as I can tell. Hope they press out.
