Not Happy With the Grade of this CGC 9.8 0

Bought this one on Ebay and was excited to get it, but then it turned into frustration.  It has one considerable spine tick and 3 other small tiny ones. 

At first glance its tough to see on this picture but if you expand it, it almost looks like it breaks color.  What annoys me is that how did this get the 9.8?  Tempted to resell it and look for another (but this book isn't exactly common in a 9.8)

Does anybody else have a 9.8 like this?

Without being able to detect any other flaws, this 1 defect could be acceptable in the 9.8 range, or perhaps the totality of defects wasn't accounted for and it was accidentally over-graded.

If you're not happy, I'd simply return it.
