If someone's got a bad-arse attitude, mows crooks down with heavy hardware, and miraculously never takes a critical bullet himself, then yah, they can put on a skull t-shirt and be the Punisher!

 

With the Punisher, it's not the costume, it's the attitude and his actions. Too early to tell how this film will be, but I'm still disappointed that Jane is so much smaller than the comic Frank Castle. He's not quite as intimidating being normal-sized, although there's plenty they can do to make him intimidating to overcome his size.
