Can anyone vouch for ebay seller "starwind1"

Here is an update on the situation. I had a feeling some more weirdness was coming. I won the Captain America #10 in VG- condition for $510.00. You can see the cover in ebay auction #170060401511. I thought it was a pretty good deal considering that the book looks pretty nice. Now, Perry wants to back out of the sale because he just discovered that the book is missing it's centerfold. He's going to return it to the original seller that he bought it from. I hope he's telling the truth, but something in my gut makes me feel that he "just discovered" this major defect because the book somehow didn't sell for the price he wanted. I just can't imagine that both Perry and the original seller he bought the book from (who apparently is honest enough to give him a full refund) would miss the fact that this high dollar book was missing it's centerfold. Hey, stranger things have happened, but Perry states in the auction that "This STUNNING VG- UNRESTORED copy will be going to CGC for slabbing and possible future sales should the serious bidders be asleep at the wheel when this item closes." That indicates to me that he could possibly be making all this up as an excuse to back out of the transaction. Any thoughts? frustrated.gif

 

Well, you did get the book for 66% guide, which is probably below the usual FMV. I'd ask him to not send it back to the original seller and to send you the book anyway, regardless of the missing CFO.

It's kind of a big gamble. Do I risk paying $510.00 for the book if it really is missing its centerfold? It's kind of like James Bond in Casino Royale; I wish I could look at Perry and see if he has a "tell". devil.gif

I sold it to him on ebay and apparently he resored it, which I thought was totally uneccesary. If I remember correctly he paid a bit more for it than it recently sold for. Well he would probabaly pull the cf out and take the picture to make it look right if what some people suspect is true. If anyone on the boards knows him they may want to put some heat on him.

 

I sent him an email this morning asking what the deal was. If I hear back I will post.

Let me stress that the Pep 28 restoration was fully disclosed in that auction and I was just posting it as a comparison of rest vs. non rest. I'm still hoping Perry has a good explanation for the Cap 10, but I do think we need to hear from him and maybe even the guy he bought the Cap 10 from, in the interest of full disclosure. This could all be perfectly legit and I'd like to give him the benifit of the doubt.

Personally, I think the restoration looks amateur in nature and does nothing to enhance the book. 893scratchchin-thumb.gif

Thanks for checking with him. I hope he's telling the truth too. It would really suck to have that book pulled out from under me like that. He was selling a lot of books with restoration in his recent ebay auctions. He did disclose all the work done (mostly tear seals repairs), which makes it all the more strange that he would somehow not notice a missing centerfold. I also won a heavily restored Target #1 for $92.00 from him, which he is still apparently willing to sell to me.

OK, I got another email from Perry and now he wants to back out of selling me the Target #1. What a complete jerk this guy is. Please spread the word and do not bid on this guy's auctions. He is completely untrustworthy. This letter comes after many days in which he ignored my emails requesting a total for both of the books that I won. I even called his house to request a total, got his voicemail and left a message requesting a total. He has been stalling me for days just so he could pull a stunt like this. The fact that he would pull something like this on me on Christmas day just shows how low this creep is. frustrated.gif I wish I could leave him negative feedback, but he would just retaliate with a neg on me. I wish there was something I could do to this lowlife. Here is his latest email to me:

Unfortunately, I was to receive payment within 7 days from the auction closing. The auction closed on 12/16/06. I dont believe I'm legally bound to hold the item for you past 7 days from that time.

Why not bid on it again when it's re-listed. Only next time dont waste time arguing over postage & insurance fees especially when the possibility of winning an item for 1/4th of it's value hangs in the balance. You have been a sport about the Cap 10 snafu. Why dont we do this? Send me a Post Office money order for the total I sent to you in my invoice dated 12/16/06 by EXPRESS MAIL, at your cost, so that I receive it by before Thursday 12/28/06. Once we have passed that date I will have no reason to sell the book as my need for the $$ will have expired as of that date. Sure sounds like a good deal to me.

OK, he's playing with you now, like an eight year old. Report him to ebay. This sucks, I would be furious. He's using a technicality to screw with you. Why on earth would you send payment if you're in conflict over a book he won't send. Come on Perry, do the right thing! I gave you a good review at the beginning of this thread!

It bears repeating to all forum members to watch out for this seller on ebay. He will undoubtedly be relisting these books on ebay sometime in the future. While he hasn't done anything outright illegal to my knowledge, his actions toward me have been highly unethical and I do suspect that he has rigged bids in some of his other ebay auctions (I have filed a report with ebay) in order to make bidders bid higher than they probably would have.

I think we all feel bad when people we've dealt with in the past display shaky ethics and bad behavior. I too wish this wasn't the case, but whatever changes may be occuring in someones life, there's never any excuse for this type of thing. I still hope to be proven wrong, but until I am........

Perry has been a friend of mine for many years, and we have had many good dealings. However I believe that when someone sells an item, they should stick with the sale. The lawyers on the boards can answer this better than I, but I am not sure the legally binding contract he entered into when he sold you the book can be limited to his 7 day term. I also know that Perry has a habit of getting himself into binds with the IRS, and at times has to sell books in order to pay them. He is probably telling you the truth when he says he needed the money before a certain time was up.
