I would call that a false equivalency, but that wouldn't even come close to recognizing the difference in the two situations.  I don't think anyone ever felt they were in danger of losing their books to CGC closing up shop and disappearing.  Or in danger of the only remaining employee becoming incapacitated if he doesn't stop working and get the surgery that has been implied.   I don't think there was ever a concern that CGC had run out of money, or the only remaining grader/shipper/everything guy was dealing with a difficult health situation.

No you're right, instead you have to worry about some new guy popping staples on your book or a new grader giving you a lower grade than you should have given been given. how about that quality control where books just get laminated into the edge of the inner well and ship that way. Always best in numbers right? Or how about when your book sat in a box in receiving for 8 weeks and all they could tell you is they're in there somewhere.

This may not be the response his customers are hoping for, but wouldn't the simplest and most stress-free solution be to immediately return all books, finished or unfinished, and declare bankruptcy?   :wavingwhiteflag:

Yes, it would. I have been considering that for some time, but I never dreamed I would have to include any clients. Maybe it's my resistance, and my desire to fix as many as I can that is the problem. Maybe my problem is just not knowing when to throw in the towel. I always say to myself well this book just needs that, that order just needs a spinal. Be real shame not to finish. Which would be okay except the time to get it to finish is not happening so choosing quality over quitting is only making things worse for me.

I don't think it's unusual for restorers to take a long time. I know I've had "quick jobs" take a year or longer to come back with other well respected restorers.

But they communicated with me and I never felt like I wouldn't get my books back.

4 years to get a book back, when you paid over $3k up front is absurd!  And Hero isn't communicating with his customers.

Untrue about communication, especially the last year I changed to where monthly updates were going out. Communication isn't the problem, it's not telling people what they want to hear when you communicate. That's the problem.

From what we know he is a liar and a thief. Unless you are calling others in this thread liars. None of what you said makes any difference. He has stolen books. Big deal you know him. That means absolutely nothing. Everyone goes through hard times. Does that mean you lie multiple times to people telling them your book is getting packed up and shipped? He has had that AF15 for YEARS. You think that is OK?

    Super duper libel.

    Stole?

Has anyone even looked up the definition of libel? I can point out plenty, and very damaging ones.

    Libel

a published false statement that is damaging to a person's reputation; a written defamation.

    CHICKEN NUGGETS!

In all seriousness - very sorry to hear that your childhood books are amongst the missing.

The term "missing" implies lost or gone. This was proven incorrect.

This was his response when I wrote that if I didn't receive a tracking # I would be forced to pursue legal means. Seems he just threatened to hold onto my books even longer should he get a call from a lawyer. My friend with the FF 5 has worked in law enforcement and is prepared to call the local PD.  A class action suit would be best, if we could find more people who have books out with him. I posted in the Facebook CGC group, with 33k members and not one person, aside from someone who has a book out since 2018 (!) that needed extensive restoration (and who didn't even seem fazed by it) responded.

I hope you don't mind me giving some advice, but don't waste any money on an attorney, they are not worth it. All they want to do is charge you and they're not going to get anything more than you can do yourself which is get your books shipped. I really don't like attorneys;; they speak to you like bullies, and it has the opposite effect on me,. Once I hear from one of them to the back of the bus that client goes. For some reason they think vinegar works better than honey, I guess I just don't understand lawyer speak. Even my own attorneys are that way, I'd rather see money go to my favorite charity and break my back to solve the problem myself. If that makes any sense.

Out of context. He left out his threats and demeanor prior to my response

I don't remember CGC calling when they were in this situation, anyone?

No, they don't. And in fact if you call them they just ghost you. I had clients waiting 16 months for their books asking them for to be returned and a refund and all we got back was no no and no

They don't offer any discount or any refund of services. They don't allow any cancellations. Once they receive the order. Their contract is not have a definitive time, but they get away with it and more. Why is that?

Hero did make the hard calls and apologies when we had the staff. Every minute I'm doing something else other than pressing shipping or restoration is eating up that time. I can't answer phones. I can't make the calls. I can't deal with the people who just want to back out and expect you know an instant cash refund when it's a lot of money. Why should I have to give refunds when CGC doesn't? I think you all know the answer why? . The only difference is restoration, yeah those got really backed up because I took an a lot and I thought the people I trained were going to cover it and then they bailed on me. That's on me but that's why it happened. I spent well over the 15% CGC gives in customer service. Just apologize for to customers for how long they were taking. When CGC's pressing was taken 12 months we were doing it in four.

And honestly everybody was fine until they heard I was sick, and then they just wanted to pull the rip cord and bail out like I'm just Bank of America

This seems to be a reoccurring theme.  "I've got a grenade and if you come any closer, I'll pull the pin".  That response to a crisis situation is what got to this point in the first place.  Saying things like involving lawyers will only get you sent to the back of the line.  That's just not the way to handle it.  The way to handle it is to make the hard phone call or email to each client individually.  Offer them options, those options must include the option of getting their books back very quickly, even if it doesn't include getting their money back or having any work done on them.  You don't seem to want to accept the only option that will bring this nightmare to an end.

I'm sorry but that is incorrect. I have offered customers any type of option they wanted except for the ones I can't provide. If you want your stuff just shipped right away. That alone is hard enough. When you have a line. If the only solution the customer wants is an immediate refund that is also a problem. People don't want to wait is the biggest problem. They don't want to wait for their book. They don't want to wait for me to finish their book. They don't want to wait for their refund and they feel they're entitled to a whole refund. They don't want to compromise. They don't want to credit and they don't want to give me more time. So one sentence is out of context. If you add all the emails together all the effort I make, then you can see that I'm being pushed into a corner that has no exits and no relief and when that doesn't work then they just charge back their card and jam up accounts receivable so that nobody's money's there. It doesn't take very many bad apples to ruin the whole tree.

  10. You know, I'm trying to do the right thing, but I am not given a fair chance. The idea that I am purposely choosing this is absurd. I have devoted 12 years of my life to this, and the harder I try, the more I sacrifice, the more I see I should be beginning like I am accused off, so keep it up. Calling on me for 30k at once, expecting me to hustle with my health, and then say stupid erroneous comments? You think making life harder for Hero is funny? Not when you realize I know more than a screen name. So, go ahead and post your grievance, with libel mis-information, and listen to a paralegal that must have spent most of his years working for a un-civil attorney. Go ahead, if you think you are anonymous,  and you want to defame me, go right ahead. I have had pros kick me in the balls, and I am still standing. What I learned in defense will surprise you.

Or, you could try to put yourself in my shoes, and understand the impossible is being insisted from you immediately. I am not some 30 something Crypto thief, I am doing the best I can, pushing my health harder than I should, and threads like this have my question why should I. I should put my health first, have my surgery, and just tell every to wait. Maybe I will do just that.

Okay, this is short and sweet. I can't settle everyone at once. Every additional client the wants to cancel only makes it worse. If this thread continues, all operations will come to a halt. I am not settling in public, and I can see CGC Mike has a serious conflict in interest. If you think cancel all at once is the solution, go try that out at a bank.

This thread has so much libel, speculative, and mis-information, there is no way I can get my point across. Think whatever you want to think, but this thread will cause clients more harm than good. While Mike allows all this to occur, a blatant quadruple violation of CGC terms of use, he has been adamant to stifle me. That is fine, the client who are creating the libel, inaccurate, public display will have tyo wait until they respect the law before I will communicate. But, if CGC Mike thinks this is all okay, I have top secret CGC communications about settlements, I will post later, if not banned.

BTW, I figured out how to copy and paste those, despite CGC's best effort to disable the function. Double standards are the worst.

No he has an AF15 of mine as well. Just came across this thread as well. Currently trying to read everyone's comments before I make a big response as well. But I paid 3200 as well for work to be done to improve my restored af 15 which was a CGC 4.5. He advised 18-24 months at a cost of 2500 or I could fast track it for 700 more and get in 6 -8 months. That was over 3 years ago. I will chime in later with all my details. And I did threatened legal action.  I just have not followed through because he assured me he will get to my book but no time frame. I was trying to be sympathetic but I am losing my patience. Will respond at a later date. On vacation currently and don't want to get all jacked right now thinking of it.

everyone who is posting something similar, please email accounting@hrcomics.com with your submission number. I will not operate on these boards, and the more difficult this thread makes it for Hero, the more difficult it makes it for clients. Posting here first is an inappropriate venue for such conversations.

And yes, I shipped those damn books out already, you can send your money to the humane society, I don't want it.

Thanks for the update.  Hopefully that will help alleviate some of the concerns and buy you some time to get caught up.  And remember your health and heart are more important than comics.

I don't understand, I typed it all out. Is there a character limit? 2 hrs I could have done shipping, now lost. this forum sucks, or someone is monkeying with my reply's.

Unfortunate series of events for all involved.

For those that have sought restoration services, was a contract executed between the parties that identified specific timeframes along with estimated type of work to be performed?

You know that's the problem? There is a contract and it's being completely ignored because it doesn't say what anyone wants it to say. If you can't agree with the terms and agreement, then don't check off the box and agree. And then decide later, You're just going to make up your own policy. Want to learn more? Read this.

"There is no indication the book is lost"?? Do you not know if you have it or not? Why are you using passive voice and indirect language? If I were an aggrieved client, I would think you sold my comic(s) for cash to float business expenses. It's a simple question really: do you or do you not have the mentioned books in your possession?

Exactly. I should have said as much to Mike before he shipped my books, as I see they've been sent UPS without signature confirmation. They're due to arrive on Monday; the last update on the UPS site was from 6/14 at 12:29 am saying they left the Portland, OR branch (after being delivered from Albany, OR, close to Lebanon, OR where Hero is located). Crossing my fingers they arrive safely. I'll report back here.

I had no idea the software was malfunctioning. It looks like I have to click signature twice before it actually adds it to the total.

    Unbelievably I am grateful.

It shouldn't cost more than uninsured USPS registered mail.  Either the owner's collector's insurance policy or Hero Restoration's insurance will cover anything lost in the mail if certain conditions are met, such as using an authorized carrier/shipping option with signature confirmation.  That's the benefit of having a policy, you don't have to spend needless money on double coverage that won't even apply or be paid out if they purchase through USPS, since another policy is inforce and existed prior.

Should or shouldn't? Unless you've read the policy you don't know. Not my job to educate you on what shipping options are available. Go look it up
