Puffery is not actionable. It's like a lot of listings I see where the seller quotes a gpa price but they selectively use the highest gpa. Appropriate for a book that doesn't trade often but for a common book? Diligence is required as there is plenty of shady going on here.

. I would say the book is yours to do with as you please. A reasonable time has passed for him to perform and he hasnt. the sale is void. If you can't contact him, you can't refund. If he does resurface, a refund would be in order. Has the concept of establishing a "court" been floated on the boards? Not that anyone wants to take on the responsibility of being the arbiter of transactions, but in cases like this where OP is concerned about board fallout if he sells the book and the buyer later resurfaces, it might be beneficial to get some determination ahead of time from the boards that his actions will not run result in a HOS or PL mess.I'll pose this question for a possible answer.A member bought a book of mine over two months ago. He sent payment without including shipping. He lives in Canada which I wasn't aware of until after receiving payment and also which I clearly explained in the thread would be at cost.
I PM'd him and he never responded. I sent an email to his paypal address which was bounced back as being invalid.
I have his book packaged in my office and would even eat the shipping but he hasn't responded and I can't contact him, so I don't want the risk of it going to Canada and disappearing.
I'm past the refund time so I was going to just send him a payment for the money, but again he hasn't been on the boards since and doesn't have a working email attached to his paypal.
Do I hold the book indefinitely? Do I send payment to him for the same amount and assume he gets it? If I sell the book will there be an issue if he eventually returns to the boards and says I never completed the transaction?
Thoughts?

I think you can say that for a lot of books, don't you think? I have no evidence to back this up, but I'm confident that a good number of people own 9.8s for their exit value.1400 copies in 9.8 is ridiculous. This is a micro bubble. More hype than real demand. More flippers than keepers. Eventually the market will figure it out.I tend to agree that more flippers own this book than real collectors, and the bubble will burst and down will come flippers, wallet and all.

It's all relative, gents. 1,400 may seem like an abundance, but when there are 14,000 people that want a 9.8, it's the very essence of scarcity. 14,000 is a made up number of course, but there clearly is more demand that supply. For reference, look at ASM 129. Not a "rare" book, and there are about 1,300 at 9.2 and above. Now look at what a 9.2 goes for.

For me, the question is what purposes do either list serve? Punitive, deterrent, vengeance, warning? Neither prevents the transgressor from transacting. It seems that the public shaming that occurs (either in the sales thread or in this forum) has more of an impact so maybe that's the purpose. To provide license to others to out someone (whether it is the seller who is/has been a bad actor, or the buyer who ignores the past (i.e., the cool book shaming). Personally, I avoid Sellers on the list or nominees (whether justifiably nominated or not), but it's not the list that alerts me. It is the discussion related to the list.
