    It may not be legal, but it is also nearly impossible to prove that the auction house employee didn't look at the submitted proxy bid before placing his own bid. If it is nearly impossible to prove, then it really isn't all that illegal. Technically illegal? Sure. In practice, they can do it any time they want to do it and get away with it.
