  1. There is a DIFFERENCE between "shill" bidding and bidding on behalf of a minimum reserve. If notice is not given to the bidders that the "right to bid" by the seller or other authorized agent (the agent may be the auctioneer or a staff member), then it is illegal and that is the definition of Shilling.

     

    Now, it's apparent that you may not have read Heritage's Terms & Conditions, as they Do Disclose the right for such bidding in those Terms. Therefore, it is NOT shilling.

     

    Concerning the comment about "starting at the minimum"..."there's just one little problem. It's called Human Nature."

     

     

    Most of the time, when an auctioneer discloses the minimum and asks for bids, everyone "sits on their hands" (won't bid). I've even seen those that will call out a lower bid, after I've told them what the MINIMUM bid is... now, one might wonder, do they think you'll sell it to them anyway? doh!

     

    One might wonder that because you started the bidding below the reserve. Why not start at the minimum? I ask rhetorically, already knowing the answer--it's a game to generate interest. Can't mentally fault bidders with a doh! for playing the silly little game that's been set up for them to play--that's just a bizarre thing to fault them for.

     

    Under the law, can the seller or authorized agent bid beyond the minimum reserve?

     

    I wasn't going to post anything, but you just brought up the underlying question the laws bring to my mind.

     

    Regarding HA, because they list in their terms and conditions that they can and will bid in their own auctions, it is legal for HA or the auctioneer to bid in the HA auctions. HA states(in those reports of the court cases, referenced above) that they will set a price before an auction that they will pay for an item, and presumably bid up to that.

     

    I made the type size larger above in quotes for the answer to this question; what stops the auctioneer or the HA bidder from bidding beyond the reserve, or the official unpublished reserves set beforehand? The answer is personal honor, the decency of the individual person. In short, "there's just one little problem. It's called Human Nature."

     

    Another words, I accept that legally HA can "help" sellers by bidding up to a reserve, and HA can bid on its behalf for the sales division. But that doesn't reduce the worry or the possibility that those HA employees will do something unethical, due to "Human Nature."

     

    What happens if a book is at $1200 total, the reserve is $1400, and the increment is $100? Will the auctioneer bid $1300 as a natural next increment bid, or can they bid $1350, which forces the other bidder to bid $50 over the reserve? The numbers are just relative, my example is intended to be one where the difference between a current bid(single bidder) and the reserve is greater than one increment but less than two increments. The auctioneer ethically should only bid the minimum amount needed to get the next bid to the reserve, and not beyond it.

  2. Please don't use paper or newspaper, or shredded paper for packing. Any paper has no crush factor to it, no internal volume. All paper will crush to its smallest size or volume with any force. So the "air" between the not fully crushed paper does not resist impacts.

     

    Paper will be like a layer of paper around objects, it adds a thickness to the box you could say. The point of packing material is supposed to be for absorbing impacts, resisting forces that could reach the item. Paper does not do that, it compresses instantly to its thinnest dimensions(crush it in you hand before you think of putting it in the box(that's the amount that the box thickness is increased)). The air which any of that paper is holding space inside, that air moves aside instantly and the force keeps going in, into the fragile article.

     

    Use bubble wrap or peanuts, they resist impacts the best. Try to compress a handful of peanuts that you would use along one end of a box. Then take the amount of paper you would use to fill that same space. Compress that in your hand. Tell us which one when compressed, is thicker?

  3. That sounds shady to only list highest ever prices, but I agree that the buyer needs to be sure of what they think the value is, before claiming it.

     

    That being said, it should be no problem to figure out what the buy price is when a :takeit:

    is posted. There should be time stamps to prove when the prices were changed, and when the post to buy it was.

     

    I hope that isn't a trend , I'd prefer sellers to use the most reliable value based pricing, not the highest sale they can find.

  4. I believe most state sales taxes are based on the actual in state sales expected. If less purchases occur they will raise the tax rate, but if they went up I doubt the rates would come down. We have 9.25% sales tax here, but we have no income tax either. I won't buy from Amazon here if they don't get an exemption from the taxes.

    And upgraded my ASM 39 7.0 to this in an unexpected win.

     

    Only one more book to go (Amazing Spider-man Annual 1) I have quite a few eBay dollars to spend so I will look into that in a week or two.

    HA had some nice spiders in the 9.0-9.4 range last night that all seemed to go pretty cheap. I would have loved to grab 2-3 more but just have too much going on this month to be grabbing a bunch of Spideys :sorry:

     

    Thanks... Heritage is more miss than hit for me as they charge tax on order going into NY. WIth buyers premiums combined with tax it is hard to get anything even on average price. Most of my winnings come from eBay, CLink and the boards. Sometimes this even affects my buying through Metropolis. Why pay more?

    It REALLY sucks when you just happen to be one of the unlucky putzes that lives in the home state of whatever auction house and get banged out for the sales tax :frustrated:

     

    Yep, living in Texas and bidding through Heritage means their buyer's premium plus another bite for sales tax. No fun.

     

    I think friends might help to save you guys the taxes. I like mail order to avoid those taxes, and Amazon is about to build a distribution center here.

Maybe going forward, just make it part of your auction terms -- "because funds are going for AC's buyer refunds, I need immediate payment on these items -- after 7 days of non-payment, I reserve the right to release items back up for sale", etc. That should hopefully get peoples' attention.

     

     

    How about "Payment required within a week, unless other arrangements are agreed upon."

Sure i would love it if he did the right thing by sending the book or even better making a donation for the amount i was out to charity but that won't happen. So i just want this over with now, i've seen too many people arguing with each other, many whom i consider friends, and it's not what i wanted at all :(

     

    That's definitive enough for me, especially as a response to the conversation between POV and me.

     

    I'm considering this dropped- like a lot of people, it has colored whether or not I will do business with Pimp.

  8. If he goes on the PL, what's the resolution that would get him off again? A big reason for the PL is to get a transaction completed.

     

    The only time limit I am aware of was when we added off-board transactions between board members. That took effect after that rule was voted in...no grandfathering of old off-board transactions.
