I sent it in its polybag. I was told that the polybag sealing process does some damage, along where the seal was, also there is a 2 inch ding along the back cover that doesn't break color.

This only pertains to the retail market. To sell it as a collectable in the ebay market place is totally legal and acceptable. Darth will get no critisism from this guy as far as his selling techniques go.
