I did pay via paypal. I did provide him a link to the picture of the damage. He seems to not want to offer me a refund until he gets a refund from FedEx. I'm sure they won't cover his claim. He had improperly packed the item. If I send him the book back what assurance do I have that I will get refunded? At the very least it's going to take forever...

I don't know what to do...

Show him the pic of the cracked slab.

If you still have the envelope he sent, take a few pics of that too. Will show his and your name, so it will be known thats the thing he shipped that slab to you in. Take more pics of the cracked slab too.

All that proof should be enough he couldn't do shlt to fck you over.

Yeah with him not working with you, it will take a lot longer now. I hope it wasn't too much money.

I opened a case with ebay and it just says if we can't work it out by the 14th I can escalate it. Do I seriously have to wait that long to get them involved?

Yes, unless the seller responds and then you can escalate it immediately.

I would stick it to this tool and let ebay pay for the return shipping.

I know I'm wasting my time, but...

We see dozens and dozens of these kinds of posts here, and there is a very simple solution. Stick with safe, dependable dealers. Period.

Go to shows and find out who grades and prices the way you like... when you're traveling check out shops you know sell on eBay or other venues. If you can't check out dealers personally, get recommendations from friends or other posters whom you trust.

If you choose only to buy from the top 20-30 (most dependable... not necessarily biggest) dealers in the country, and add to that the safety of the big auction houses, you will have access to hundreds of thousands of comics per year... more than you can possibly ever look through. These people will know how to pack, and will take returns if there are problems.

You may pay a bit more... but as is always true, you get what you pay for. And in the long run, you'll actually pay less... less in actual wasted dollars, less in time and effort returning items and arguing with sellers, and far far less in frustration.

If collectors care about their comics and their hobby, why treat it as a big casino just in the hopes of getting a "great deal"? Not only that, you keep in business hundreds of eBay and Craigs' List scumbags who are either outright crooks or impossibly incompetent, and who compete with legitimate dealers who are trying to treat you right.

Rant off.

I sent him this message with a link to the picture of the cracked slab, WTF???

Here is a picture of the damage the case has incured. http://i48.tinypic.com/2ibg5sm.jpg

I am not going to send you back the book without the agreement that you will be giving me a refund for the book. I'm sorry but I am 100% certain FedEx will not cover this damage. You can not send a cgc slab comic through the mail in nothing but an envelope. That is improper packing and that's what they will say.I also can't take the issue up with Fed Ex because I am not the fed ex customer. You are the one who paid for the shipping, you are their customer, you are the one that can try to file a claim. If you won't agree to a refund I will have to escalate this issue with ebay.

If you do agree to refunding me and provide me with your return shipping info I will get the book back to you as soon as possible.

And this was his reply

Really thats what your fussing about really! Take it up with eBay I'm done with you there is no damage to comic.Have a nice day do not contact me any further. Take all issues with eBay

I just had a CGC book delivered in this recently. It was a magazine size book, so the case was even more fragile than a regular comic case. I had sent the seller an e-mail via Ebay and Paypal beforehand requesting a "well padded box so that the case does not crack during shipping". It's not an envelope, but I wouldn't call it a "box" either. It is basically cardboard wrapped around the book with zero padding. Not surprisingly, the case has a crack in it....

Ebay has you covered. As a buyer, you are ALWAYS right (according to ebay), however in this case it's a no brainer. You do have to wait to escalate the case, but it is what it is. At least you're covered.

Wait until you receive a full refund through paypal (which you will) and then leave him a negative. At the very least it's what they deserve.

A padded envelope

Are you frikking kidding me?

I had a CGC Showcase #4 sent from the US to the UK in a padded envelope.

Miraculously it wasn't damaged.

Sometimes you get lucky.

I had a person ship me G.I. Joe #154 from the UK to Baltimore.

He sent it in an envelope slightly larger than the comic. No board. No padding. Just the comic in a bag.

It arrived completely flat, unharmed, and - to my surprise, since it wasn't advertised as such - signed by Ernie Stiner.
