  8. The above post about Crain having his own custom label reminds me. It is entirely 100% inappropriate for a purported independent 3rd party grading company to sell special vanity labels. It is this stepping out of the world of grading/authentication into the slab becoming the item of interest itself that greatly reduced CGC's legitimacy in my eyes. CGC should always be the authenticator/grader, not the actual object to be collected. Crossing that red line was a big misstep.

Hi Everyone, Something I enjoy doing is using pieces of comic books (I only use moderns, nothing valuable was used) to create a new image, much like a mosaic, but with comic books pieces instead of stones or glass.By deconstructing those books and then piecing together hundreds of characters into a single image I attempt to create an infinite number of possible storylines. If you pick any small area on the canvas you can create your own story.   12. You left out the key question. If you remove the acetate and submit it for grading, will it get a 0.5 Coverless?

  14. I predict that CGC will announce that they will no longer grade these books due to Marvel's statement that they were unauthorized. The number of books is miniscule. The potential profit from grading these books is just as small. The pros are completely outweighed by the cons. It's really a no brainer.

I think this is primarily a question of fair use of which there are 4 factors to consider: "the purpose and character of your use. the nature of the copyrighted work. the amount and substantiality of the portion taken, and. the effect of the use upon the potential market." Fair use implies infringement. Fair use is a defense to that infringement. Here the purpose of the use was commercial - to sell the variants for a profit. The nature of the copyrighted work is an original story and art owned by Marvel. The amount of the work taken is the entirety of the work - it included the entire copyrighted comic book. As to the effect of the use upon the potential market - it is a small number of books (750) but it is also depriving Marvel of the ability to make their own derivative work involving a patriotic acetate cover. *DISCLAIMER - not legal advice.

  19. Cease and desist probably incoming. I would think Marvel would want to stop the releases that haven't occurred yet. May demand that Black Flag donate all profits. Marvel of course has to weigh their legal rights against public relations.
