  1. Well, the vote's 31 to 18, it's been a week, and you all decided. I would have honored the decision no matter which way it would have gone. Despite the misgivings of my well-intentioned friends, when people invent things about you out of thin air, anyone is hard pressed to not say something about it, especially...especially...when they say it when you can't reply.

    I voted no too but if it hadn't been that argument, it would've been the next argument he got into shortly afterwards. Arguing seems to be part of RMA's ideal board experience.

     

    What a shame, he goes ape mess a month ago, telling anyone who disagrees with him to put him on ignore. Many of us did as requested. He then goes out & finds someone else to create a fight with as soon as he gets back. Hopefully the mods will get tired of his act & just ban him next time.

    As in calling a black person "Boy". Instead of as you were talking about the little black boy that is in the film clip saying "That's Racist!" that has been played on this site multiple times.

  3. The added time by allowing time payments is irrelevant. The seller was apparently quite willing to wait for the payments and did not seem to ask for extra compensation.

     

    Has the buyer refused to pay?

     

    In the end the buyer did say they didn't want it(after reading several PM's but not responding to them)...which was understandable not being able to pay in the situation. But think the lack of communication and taking the time to read the message and just disregard it. Like Bio-rupp stated that if a seller asks if they still want the book, and plan to make payments etc, after little to no attempt has been made to make payments/communicate with the seller then the time should be started.

    In regards to the Spider-Dan situation: He wasn't even talking about probation when he started the thread. He wanted to know when he could re-list his book without violating any Board Rules.

     

    Truthfully, the 30 day waiting thing was brought up because people do not always list a payment schedule in the listings. If there is no payment schedule in the deal then the 30 day waiting period was thought to be beyond fair. Repeat, if no payment schedule was mentioned in the deal, to be fair to the buyer, 30 days was considered more than enough time to scrape up the cash & get it to the seller.

     

    Spider-Dan did have a pay schedule with his buyer. When it was not met, the contract was broken & he should be free to do as he needs to. If my daughter breaks her arm & in a panic I need to raise $800 I would list a book & say the payment must be received by midnight. If payment is not received then I should be free to re list the book the next day to get the funds I need. I should not have to deal with any of the probation committee coming into my thread & telling me that if I want to stay in the good graces of the board I need to give the insufficiently_thoughtful_person buyer another 30 days.

     

    It's common sense.

  4. I recognize that your only focus is on the time it took for the book to get back into your hands. The statement you are choosing to focus on was this:
    Without some time limitations - couldn't anyone who has had ANY book returned to them that was subsequently resold for less make a PL nomination seeking compensation from the original non-buyer? That is the logic you are employing here.

    This statement was in relation to YOUR resale of the book for less. Why did you sell it in May 2009? The original sale took place in January 2009, that is something you and the seller both agreed to. Your resale in May establishes a second market price that you alone established with another buyer.

     

    Could you have waited longer to minimize damages further? Did you choose the best venue, were your scans good, did it end on a Sunday night or Tuesday morning, BIN or auction, sold to friend, dealer or stranger?

     

    When the original transaction has been reversed it is only YOUR reselling of the item that created the loss you seek to recover. In reality, you had the book and he had his money - same as the day before the sale.

     

    A regular comic dealer would likely be frustrated with the delays as you were, but most would accept taking the book back into their inventory with no beefs about the rise and fall of the irrational aspects of the market.

     

     

    Sorry, but all of these concerns were addressed in civil case law decades ago, and the law sides with me. The book was sold again in May of 2009 because that is when I got the book back. Civil case law does not require me to "wait, on the chance that I can mitigate damages further"...it DOES require me to mitigate my damages, which I did. The buyer, by not ensuring that I received the item back in a reasonable amount of time, CREATED these damages. So, no, it's not a "same as the day before the sale" situation.

     

    And when you REALLY get down to brass tacks, eBay purchases are a contract. When you bid on and win an item, you accept the item at the purchase price, so long as it is not significantly not as described. Since this book was in precisely the same condition when I finally received it back from the buyer as it was the day CGC graded it, the contract was valid. He bought a CGC graded 9.8 Batman #428, and he received a CGC graded 9.8 Batman #428.

     

    If I really wanted to be a about it, I could have sued the buyer for the entire amount, and forced him to complete the transaction, AND paid shipping costs,. AND court costs, AND all other costs associated with this transaction, including interest if allowed by law....and I would have won. He won a CGC 9.8 graded comic book...he received a CGC 9.8 comic book. Whether or not he had an issue with CGC's grading has nothing to do with me. He got EXACTLY what the auction said he would get.

     

    In fact, depending on the statute of limitations wherever Dekeuk lives, I may STILL be able to sue him in civil court for the entire amount, minus the mitigated price obtained upon subsequent resale. I could probably sue his card issuer as a co-defendant for ripping the money out of Paypal (and thus out of my account) without demanding proof that the item had been returned by the buyer.

     

    Which is why:

     

    1) No returns on CGC graded books.

    2) The customer isn't always right. :baiting:

     

    Are you serious? CGC slabs can turn a 9.8 book into a 9.0 after a couple of trips through the post office. There are a ton of books sitting in slabs that don't resemble the original grade given. I'll never buy a book with that kind of return policy & more & more dealers have given up trying to pull that on customers.

    That's NOT healthy, and it's NOT something that should be encouraged.

     

    Yeah, I saw an example of this a few pages back, some tool was complaining about a transaction he had in 2009.

  6. I've seen a BUNCH of times where someone has been immediately taken off the list for some pretty bad transgressions because they were buddies with the people screwed over(deafmutecomics comes to mind).

     

    Jay was removed from the list once he made things right with every impacted member - isn't that right?

     

    If I'm confused with that situation, please let me know. But he didn't come off that list instantly, because I remember impacted buyers checking with each other to make sure everyone was made whole.

     

    If the point of this thread is to warn new buyers & sellers of people to avoid, why in the world would a mass offender ever be removed from the list completely(wasn't he the one who stiffed a bunch of friends)?

     

    I can understand having a notation that they were shamed into making things right & to deal with at your own risk, but personally, the names should remain on a list as a warning to new members.

     

     

  7. I bought a set in the 90s from a dealer that had stacks of them at a show. He informed me that they were the Mexico bootlegs & he could get as many as I wanted. The set I own is definitely the later bootleg version & it has the date (XVII) on the bottom. The date info was deleted out for some of the bootlegs, but having the date definitely doesn't authenticate the figures.

     

    I have to disagree with an earlier post that said the colors have very little to do with authenticating the figures. The red color used in the 3rd authorized set is much different than the red used in the bootleg set which I own (which is he same as the photo shown in this thread).

     

    All the sets use the same mold, so whether it was made in 1967, 1970, 1972 or the later bootlegs, they will all show the 1967 date ( with the exception of when the writing was removed from the base).

     

    There are many, many bootlegs with the the dating on the bottom. I would estimate that 90% of the sets seen on ebay are the bootlegs, even though they try to pawn them off as the originals.

    Not 100% sure, but I believe this was one of the bootleg sets that were produced in the early 80s. I bought the same set for around $15 in the mid 90s. The first 2 sets were grey then silver. The 3rd issue was in assorted bright colors. The bootlegs were produced in the 80's when someone got a hold of the original molds.

     

    Still, a very cool set...

    This is an odd comment. Did you have a reason to not trust the buyer before sending the package? Is it a board regular?

     

    I'd just send the refund & be done with it, no reason to send your last copy.

  10. It is a good series, and still affordable too :)

     

     

    That series was much more expensive over it's first 6 months than now. I really enjoyed it during the Golden run but lost interest soon after. The book was seriously hot over the first year.

  11. Great pics Boomtown. Where are the 20 centers? Batman 251, Superboy/Legion 197 and Supergirl 1 all exist in multi-pak format. :cloud9:

     

     

    I forget the sellers name, but a few years back, someone sold a huge hoard of multipacks on ebay. I think Showcase or Neat Stuff ended up winning it. They had multiples of all the 20 centers in the collection. Really amazing to see at the time.

Another collection scored off of Craigslist today (it's still worth checking): Hulk 181, ASM 129, IF 14, FF 25, ASM 121/122 etc. As well as a bunch of moderns -- but good moderns like ASM 300, 299, 298, Deadpool 54 etc. Full set of Wolvies 1-148, plus Nabisco giveaway. Got a nice bargain too.

     

    It's still worth hunting them down on c-list.

     

     

    Yeah, I check Craigslist weekly.

     

    There's a ton of over priced junk, but occasionally you score nice.

     

    Few months back picked up a few short boxes that included 3 of the 4 Miracleman TPB's, a nice Preacher run, Hellboys, a Lobo slipcase set, bunch of Sin City books & a load of early 1st edition trade paperbacks.
