I don't think the pre-sale offer to pay GPA is relevant since a price was offered & accepted - this isn't about going back to the pre-nomination discussions this is about a guy coming off the list. I do agree that the nominee was a n00b at the time and may have been inexperienced with regard to offer/acceptance being enough to be considered a deal. I don't feel as a community we have a role judging negotiation skills or tactics, I prefer that the nominator be given opinions to make his choice. I do agree with a less punitive Option 2 and shared that opinion with the nominator. . Here's the thing. Much as in the outside world we don't have an "eggshell skull" standard of conduct we have a reasonable standard that everyone is expected to abide by, meaning we don't tailor our expectations of how people are supposed to deal with one another based on ignorance. People cannot dummy up and relieve themselves of all responsibility. That is especially true in cases where here may be dishonesty involved. While I agree that option 2 might sound extreme you should see the damages people are allowed when fraud is established, they make option 2 look like a fanny rub and a Popsicle. To understand option 2 look at it as if soup had sold to book as a 9.4 to someone else after October and after reneging on his deal with Matt. The average sales were over 1300. He would have generated a windfall through fraud and breach. Matt would be entitled to every last dollar of profit made by the seller that was gained through that breach. Option 2 gives the seller the option to abide by the terms of the agreement and put the purchaser in the same place he would have been had he honored the deal in place. Option 1 is cleaner and easier for some to understand but they both correct the aberrant behavior, prevent the blameless from being wronged and prevent the breaching party from profiting improperly. The last thing we need here are thousands of individual standards of conduct, one for each member, so they can then dummy up when they don't like the terms a s weasel out of punishment for transgressions. If he's got the book he needs to turn over the book for the original agreed upon price plus press and grading fees. Anything less is rewarding behavior that is not welcome on this forum. This is a great analysis. In Australia option two would probably be preferred by the courts as it only requires the payment of damages while option one requires specific performance. Especially as it is difficult to see how the original bargain could be completed as the asset bargained for has now been fundamentally changed also replacement might not work as it is questionable wether the book is a fungible.

You stare at ONE statues fine booty and these people will brand you for life! Trust me! Do you display her facing the wall? That would be very pervy. .

  14. I've come to the conclusion that if you really want a book, you'll probably have to overpay. Well done. (thumbs u Great pickup! I think this book is a great buy at anything even close to gpa. Census numbers are crazy low and when I was a casual comic collector, before I became sersiously addicted, the only other superman villain I was familiar with, besides lex luthor, was bizzaro.
  15. I totally agree. I was into comics as a kid (in the 90s) , subscribed to Wizard, etc. I didn't know what AF15 was until I started lurking this board a few weeks ago. Before I started reading up on the SA Keys, in my mind X-men 1 would be my ultimate "dream book". I mean it honestly still is (even though I somehow want an AF15 , too!) The popular characters of the present, 10 yrs ago, and 20 yrs ago, should be somewhat a relative driver of future demand. (Especially if we are comparing blue chip characters to blue chip characters... X-men and of course Spidey were big in the 90s... I don't remember any of my 12yo buddies thinking the Fantastic Four were cool!)... just one anecdote but bottom line I consider X-men to be very top tier in terms of mainstream cultural staying power. Would put Batman and Spidey in the same boat. That's how I was until I joined here. In my mind if I could get an Xmen 1 then I was set as I had always wanted one since I was a teenager. Just wondering how old you guys are? As I feel similarly. I am 24 and the two books I have coveted most since childhood are XM 1 and AF 15. Admittedly I wanted an AF 15 more as I always loved spidey more as a kid but XM 1 is a close second. I know when I was younger I thought FF was boring. I have grown to appreciate them more and ff1 does have the second best cover, behind AF 15, IMO. But nostalgia trumps the cover.
