This is not a scam.  This particular variant is what's known in the hobby as a "Schrödinger's Comic".

They used to be pretty rare, but are becoming much more common.

Once you receive the book, you simply box it up and submit it to CGC.  At this point, the comic both is and isn't a CGC 9.8 copy.

Once CGC receives it, opens the box, and then drops your comic......it isn't.

Honestly it’s all over the place in value, just look at these huge gaps on eBay alone 

I personally don’t have a copy, to many on the census for a 4 to 5K average.
