  1. It was that same book but Kindle's images were taken with a different camera and different background setting which leads me to believe he was the buyer in the eBay sale. So it sounds like he may have used you two guys as a temporary $10K+ loan at 0% interest for some other item he was purchasing. I wonder how Paypal will feel about funding the loan?

That would appear to seal the deal on what was going on here unless he can come up with an ... interesting ... explanation. He just responded to my PM that "my money was refunded".

  10. Just looking to make sure this was HOS worthy before outing anyone. I have not sent a PM to the seller so I am somewhat sensitive to naming him without doing so. I am not certain of the protocol on these types of issues; however, I am not protecting anyone nor playing games.
  11. I paid under and the other buyer paid over $5000. The book was sold on eBay December 2013 for well over $5000 (did not see this until after the fact).   13. Over $5000. I cannot say for sure but he did withdraw the Paypal funds such that Paypal had to fund the refunds, not him. We are in the process of contacting Paypal's fraud department as well.
  14. I purchased three books from his sales thread via PM. He subsequently offered the duplicate book to both of us and approximately the same time. That book was not in his sales thread.
  15. Not until after the refunds. I posted in my WTB thread that I had a large transaction fall through and the seller made the error of telling the other buyer that he was mailing out another package to an Arizona buyer- he knows me and when we started talking, it all fell into place.
  16. That is the story and I agree that we were both lucky. If we had not known each other, this might not have even been discovered. As for outing, I would still like to proceed with the merits or facts of the situation to determine whether HOS is warranted although I would certainly think so. Ed
  17. Hopefully, we are ready to move on to another discussion so here we go. I recently purchased several books from a Board member that were "lost by USPS". At the same time, another Board member was offered and purchased one of the books as well (neither of us knew this at the time). His book was "lost" as well. Again, neither of us knew about the other as a buyer of the book; however, through a bit of coincidence, we ultimately found out. There are more details, etc. but the basics are as follows: - both sold the same high dollar book by another Board member- serial # and pictures match; - both paid using credit card via Paypal; - told our package "missed the USPS cut-off for an electronic label to be shipped". We were given tracking numbers tied to our Paypal transactions that noted electronic label created but no further updates were ever made; - after several stories (not his fault, told the package made the deadline, package missed deadline and would be returned to sender, package lost), it became clear we were not getting the book; - when we asked for a Paypal refund, we were both told the same quote; "Unfortunately I allocated the funds for other assets and therefore have to wait until the claim clears in 30 days" and told to start a Paypal claim; - both of our claims were eventually paid although not as easily as it should have been; Bottom line is that both of us were made whole by Paypal, but we may have been "hung out to dry" had we not used a credit card (hard to say how the buyer protection would have gone). Since we are not out any money, I am not sure there is a specific remedy as I believe, is typical for potential PL transactions, I am not sure whether this deal qualifies; however, I am concerned that other Board members might incur a similar experience. I also feel it may be a HOS rather than PL discussion. I realize I have not named the Board member or listed the book as it seems the merits and potential actions would be the same (but perhaps not). Actually, if Ed's side is accurate I would way Ron has earned a little time in the wringer. Nut jobs tend to work their way onto the list in a variety of ways. Suggesting Ed just move on isn't a bad idea. I think Ed should move on, as soon as Ron sends him the difference (via paypal) between the originally accepted offer amount and his ubiquitous $1100 offers. Even nut jobs don't get to be unjustly enriched. Really? Why should the loon have to fork over money? I'll give you a hint. If you google the last 2 words in my last post you'll find the answer. How is he enriched if he refunded the money in full? Unjust enrichment: 30 second lesson. Seller broke contract to sell at X price and resold at higher price (Y) His breaking the contract allowed him to make more money. Unjust enrichment, courts (at least in NY) say buyer is entitled to that monies. Robocard: thanks for the post. No question in my mind that this is PL worthy. Please just follow proper protocols and he will be added. How would I follow protocol when he evidently has me blocked on PMs and sent me an email to never contact him again?

I was clear that I intended to sell the book at some point and will no longer be able to while he is out nothing but a little time (and perhaps his reputation).

So we spend 30-40 pages on a $16000 book and let the little ones slide? I would like to not have others go through this as well but I do not plan to ever deal with him again (although technically to resolve the PL issue, doesn't he have to complete the transaction- rather than just resort to name calling)?

No one forced you to accept the offer nor was there any pressure that forced you to agree and send me your paypal information to complete the sale. If we had an agreed sale how are you getting offers for the same book "bouncing off the walls"?
