I wonder if that makes it better or worse? Regardless of size, it's still a defect. Is CGC really trying to cut costs by using sub-par materials? That can't be the reason this continues....can it? My assumption is that they would have to shut down for a while until they got a shipment of barex inner wells that did not have the defect.. It was decided that the cure was worse than the disease and they are going to use them until they are gone.

I'm no lawyer, but couldn't the doctrines of promissory estoppel and detrimental reliance come into play here to turn this gift into an enforceable contract? Did not the promisee rely on the anticipated gift of the promisor in offering his (the promisee's) gift to the next person? Can injustice be avoided other than through enforcement of the original promisor's promise? That sounds like a bar exam question.
