You are absolutely correct, as stated in Rule #6:

 

6) After a submission is solved, if the solver fails to make a submission within 1 hour, then the first person to point this out becomes a winner. The solver retains winner status and may make a sequential submission at any time.

 

By completing the Excelsior!, MojoComics had the ability to make 2 submissions, but did not do so within the 1 hour time frame.

Just some points of clarification.

 

Under Rule #7, you can become a winner by reducing degrees, and then make a submission. This is true for all existing submissions. So you were absolutely correct in trying to reduce an SL4 to an SL3.

 

7) If you can reduce the degrees of a previous winner, you become a winner

 

However, there is no direct connection between the "actual" Truman Capote and Philip Seymour Hoffman that I can see. So, unfortunately, the SL3 is not valid.

 

Which brings up another point.

The game is designed to be self-policing, so if no one objects to a solution, then it stands. And if we ever get to the point where there's a disagreement that can't be solved, then majority rules under a poll submitted by the objector.
