My guess is that they are sold out and can't replace the damaged copy.

I just picked up the last issue of 1 at my LCS. He had at least 3 or 4 issue hung around for a full month.

Highly unlikely they'd make a guarantee. Yet 9.8 SS copies are not only guaranteed, they are witnessed!

And a lot of these big stores that get 100's of copies, will pre-scan copies for CGC submission, put those to the side and sell the "bad" copies.

the signed ones I got from Midtown would have been 9.8 if submitted....course mine didn't have a safe dropped on it during shipping.

I had made complaints to Midtown for getting so many damaged comics. Now everything is shipped in a sturdy box. Apparently some notation was made on my account for all orders even if it's only one comic.

Issue 2 was enjoyable in a 'what the eff is going on' sort of way. No real answers of what's happening from issue 1, and more mystery added.

On to the wait for issue 3!
