Weird, I'm working on a chapter in my book where the pov character, a loveable rogue of diminutive stature, keeps asking himself that same question over and over again having lost a SA Avengers page his brother gave him as a gift years before "where does all the silver age art go?".

"Loveable" seems inappropriate for a potential peddler in stolen goods and "rogue" certainly seems somewhat of an understatement -

Well - in short - if you own Ditko Spideys, they were originally stolen as neither Marvel nor Ditko were the original sellers.

If it's Kirby and

- it's on the warehouse list

- not on the list of art returned to Jack

It's the same.

 

Of course we can nickel and dime a few exceptions but the general rule is good ( well, bad really ).

 

Whilst from some of the responses above I get that horse and water feeling, herewith a few snippets from the huge ! masse of literature on the stolen marvel art. For the sake of balance, I have included data from the rationalisers who have had to find tortuous means to convince themselves that their art is untainted. Enjoy. All the best.

Plenty of art from that list has been sold publicly at auction (like Unca Ben, a number of pages from my collection are on it). Most everyone knows that a lot of the art out there was originally stolen, but they also realize that almost all of it has been amnestied as well. If a police report wasn't filed back in the day (and it wasn't for the Marvel warehouse theft), the statute of limitations has long run out.

It seems to be a requirement that every six months someone gets into this. And guess what? IT'S A GRAY AREA. It was a gray area, it is a gray area, and in six months, it's still going to be a gray area. If you're uncomfortable with ambiguity now, here's a certainty: you're still going to be uncomfortable with it in six months. So hey, let's let Irene Vartanoff have -- as per one of your links -- say something smart to us all, because I like how she said it:

 

What if you bought a page of Kirby artwork with your entire life savings? Chances are that the company or person you bought the artwork from did not go to the Marvel Comics offices circa 1980 and steal that page. But maybe that page was stolen, and a few buyers later it has come to you. Legally, as of today, you are in the clear. Morally, what is your responsibility? I don’t know. We each have our own thoughts about who owns comic book original artwork that was produced as a collaborative effort at a time when no one, not the artists, nor the letterer, nor the writer, nor the publisher valued that piece of Bristol board once it had been used to create a printed comic book page.

I don't get why "If you own a Ditko Spidey, they were originally stolen" when Spidey 18, 20, 22, 23, 29, 32 are missing from the list entirely (meaning they were never in the Marvel Warehouse) Thus 16% of all issues were never accounted for.

 

Then there is the issue of the page count. All of her total numbers are supposed to be "the number of originals Marvel had to each issue". Yet they are all missing 1 page. I am assuming that would be the cover. ASM 38 is missing 2. 21 pages(20 interior pages +1 cover) but official count is 19.

Those issues were not there when Irene did her inventory (1980 irrc?) So they were never returned from Eastern, removed (stolen, given away, whatever) earlier or Irene made a big mistake (unlikely, but never rule out human error!)

This is a somewhat related situation: almost all of the DC ashcan editions in private collections (including mine) were stolen. Employees took them home (Sol Harrison for instance) for one reason or the other and didn't return them, and others just plain stole them and fenced them to collectors.

 

In the early 2000s I contacted then president and publisher Paul Levitz to get his opinion on whether DC would ever want them back and if he felt DC had a claim to them. His response was that DC would not seek to reacquire any of the stolen items. He didn't go into detail about why not other than to intimate that too much time had passed.
