  1. Interesting question...I had a similar nagging thought. I think wipple has a case he could argue should he choose to do so, but having said that, I think this structure indeed introduces some grey area into the situation. Also, I must admit that generally I'm not a fan of the "I'll take it if he passes" type of post, although it's tough to put a finger on why it bothers me...maybe it seems too close to a 'pre-emption'...the book isn't actually technically for sale again until the first "contingent" buyer officially passes, so can it be taken by a second buyer before that happens?...

  5. Would you make this same argument on behalf of a n00b who was put on the PL for not following through with a commitment to purchase a book "they no longer want"? This situation sucks, and many of the arguments on behalf of Bob are fairly sensible...this one doesn't fly, though. Otherwise, the whole notion of the PL for purposes of enforcing 'take its' goes out the window. Also, hypothetically speaking, perhaps this wouldn't be Bob's only recourse...but still, most of this is just until we hear from Bob, right?
  6. I have no doubt that Bob is a fine guy. However, I don't like the tone this discussion is taking...it's starting to reek of 'the PL mechanism shouldn't be enforced equally against all boardies'...and some of you might recall how I feel about that type of thinking... As far as this goes, we need to think of Bob as 'Boardie A' and Spider-Dan as 'Boardie B.' Further, as far as this goes, the value of the book shouldn't matter, either. Nor should the stain, unless there was a contingency included in the deal. Could be any two boardies, with any book. Should Spider-Dan have waited to get the book in hand before selling it - probably. Should Bob have gotten the notes before agreeing to the deal - probably. But if that didn't happen and a deal was committed to, if Bob indeed failed to follow through on the commitment, he's subject to the PL, and it's up to Spider-Dan (and Bob) to work out a satisfactory resolution for Spider-Dan. How could Bob rectify this? The same way a n00b with a low-dollar book would rectify it... I agree that it is unfortunate that this is happening with veteran boardies on a 5-figure book, but the process doesn't vary based on these dimensions...it's equally applicable. So, the next thing that we need to know is Bob's side of the story, from Bob himself, so it can be assessed whether he failed to complete an agreed upon marketplace transaction. If evidence bears that out, it is what it is. Ed
  7. As written, these are arguments against the general notion of imposing some type of restriction on noob seller/buyers. There are also arguments out there against the specific "post count/membership time" restriction mechanism (not necessarily "my" arguments, mind you, just ones I've seen): 6. To a scammer with a little patience, the membership time/post count is not much of an impediment. They can simply register, wait out the two months (all the while posting dancing bananas everywhere), then start hitting it under false cover of "meeting the requirements, so they must be OK." 7. A boardie's membership time/post count information is readily visible on every post...even more obvious than the PL...so it's hard to argue the need for further policing of that issue, given the relatively obvious nature of the information.

  11. At a minimum, someone should think about putting HusTruck into the "blocked eBay buyer list" that slym started in CG, HERE . Speaking of which, when slym started that thread, he mentioned the possibility of, in principle, consolidating that list to make it easier to view. If we went ahead and did that consolidation, perhaps that would be an alternative place to get ne'er-do-wells on a visible list...of course, this will only work for boardies with eBay accounts...

Doesn't sound very interesting. Although I must agree with you that endless discussion of solutions without ever seeing any of them pushed through to implementation is equally .
  14. Look...HOS/PL sellers starting sales threads sucks - no doubt about it. I wish we could kick those threads out. But, right now we can't. This is written in the marketplace forum in plain view: "A probation list for bad transactions is maintained by the community. You are still responsible for your own transactions." Maybe make it BOLD, RED, and add "For the love of community, Pretty Please click this link to check the PL/HOS list before engaging in a transaction; otherwise, you're a insufficiently_thoughtful_person."
  15. Policing sales threads requires a rule to be broken...otherwise, there's no policing to be done. HOS/PL sellers are not breaking any rules by starting sales threads, just like roofers who have BBB ratings of "D" aren't breaking any laws by continuing to advertise their roofing services.
  16. Because those sales threads are not in violation of marketplace guidelines; therefore, posting this information in their threads is threadcrapping under the current system.
  17. I'll help be the Devil's advocate here. How is it that an HOS/PL member starting a sales thread is "spitting in the face of the community"? It's not against marketplace guidelines for them to start a sales thread. Rather, it's up to the community to ignore those sales threads, and perhaps direct scorn towards those members who choose to do business with HOS/PL sellers...but that's a different matter entirely...
  18. I understand the emotion of hypothetically wanting to "allow" boardies to back out of deals with PL/HOS members...I share that emotion. However, logically, I'm not so sure how I feel about this...isn't it a buyer's responsibility to figure out whether a seller is on the PL/HOS before hitting the 'take it'? Not sure "not knowing" is a legit excuse...the link to the PL/HOS is right there at the top of every marketplace forum area...we're not children. If someone doesn't understand what's going on here (or doesn't care) and starts transacting, that's on them, to a large extent. I like to think of real world analogies for stuff...suppose I need a new roof on my house. I go out and sign a contract with ABC Roofing Company and agree that I'm going to pay them do my roof. Later, it comes to my attention that ABC Roofing Company has a 'D' Better Business Bureau rating, and I'd rather not have them do my roof. Tough - I can't get out of the contract I signed on this basis. I should have done my research before I signed the contract, right? Just sayin'... Now, if it was against the rules for PL/HOS members to start sales threads in the first place, that would mitigate this problem before it starts...maybe that rule change is what we should push for...

  20. I hate to bring this up, but there seems to be an unfortunate problem. I just read and re-read the marketplace rules again. I can't find a rule in the marketplace guidelines against an HOS/PL member starting a sales thread. Can anybody else find it? If it doesn't exist, it should...otherwise, I don't see a basis for the mods to poof these threads...if the mods don't see those threads as being in violation of marketplace guidelines, that might explain their stance on the threadcrapping, etc.
