3 years in prison for comic books

I'm cool with this. But I hope there's some type of therapy or counseling involved too. Otherwise they just sit in jail getting lonelier, angrier, crazier, and stronger. As bad as the comics are, it would be a lot worse if the behaviour escalated.

The case was initiated based on a complaint by the man’s wife, who reported that she’d found files that she believed were child pornography on his computer...

 

The titles of the comics were not revealed. The D.A. claimed that they "clearly lack any literary, artistic, political, or scientific value." That question, which would be required to determine whether or not the comics were obscene, was not litigated because of the guilty plea.

 

His wife turned him in. That says enough about how serious and far reaching this individuals criminality. They make it seem like he messed up by not using his First Amendment right to contact CBLDF, but there has be to some cut-off point where the CBLDF just says no, and child obscenity charges is pretty much where I'd draw the line. 2c

See ya scumbag. I think there's plenty of room in the industrial correctional machine for this thought crime, and the pieces of drek who produce it. No sympathy whatsoever for men who fantasize about sex with children. They should put a gun to their head as soon as they realize they are depraved of mind.

I do not believe there is rehabilitation for this, nor as a society should we risk experimenting at the risk of a childs welfare. I am pretty firm on my stance here, and prison is NOT my suggestion.

I've been led to believe there is no help for these miscreants. Whose child has to be sacrificed to find out if treatment is effective? They aren't worth it. Anyone who knows they have allowed themselves to become this degraded should take care of themselves for us, either by sitting on their hands their entire life, never acting on their impulses, of they should kill themselves and save us the pain and trouble. Useless humans, absolutely useless.

Agree or disagree with the law, it existed as he was committing the crime. I don't think marijuana should be illegal, but if a dude in Kentucky gets sent up the river for having a dozen plants, that's the risk he took when he did it

Haven't read the link, but if his charge had anything to do with child, sex, rape (to any extent) - his stay in jail will not be pleasant.

Perhaps... but in some cases, all it could be is a naked alien hybrid kid emerging from an alien pod and some whacko county law could be used against the poor schlub to throw him in lockup for three years.

 

If it was what could be described by commonly held accounts of child pornography, then may he be introduced to the general population at whatever site he is being held in order for them to exact their feelings on the matter.

 

If this is yet another case of rural bible belt standards being pressed upon the general population, then it again amounts to another reason why I like to stay up here in NY.

Without knowing what images or comic related material was involved it is impossible to pass judgement on the individual or the case. Who knows what the prosecutor considers obscene in that jurisdiction? As Charles Brownstein of the CBLDF states, it could have been something along the lines of an old Robert Crumb underground comic. It could have been any number of manga comics. Heck it could have been an Image comic. We once were reported to the Houston vice squad for hanging a Fathom/Witchblade poster in our store window. It is obvious this guy couldn't afford quality legal representation. And any number of comic book images could be misconstrued as child pornography by someone looking to find it. Consider how Wertham classified Batman and Robin. So be careful before you say "string 'em up" without knowing all the facts. The next obscene comic they confiscate could be yours.

I live in MA - you don't get too much more liberal. I was referring to the community within the prison not the legislative intent behind enacting the law.

According to United States Code, Section 1466A, it is illegal for:

 

Any person who ... knowingly produces, distributes, receives, or possesses with intent to distribute, a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting, that -

(1)(A) depicts a minor engaging in sexually explicit conduct; and

(B) is obscene
