I change my opinion, I would think the book would go to Transplant. in the thread trumps PM negotiations. It seems like negotiations were over and a deal was struck. Dan's rules were not that the thread beat out PM negotiations, it was that the thread beat out all PMs. Pretty clear that to win the book in Dan's thread, it had to be announced before anyone else made a claim in the thread. Some may not like it, but the rules were clear.
  2. Yes, and this nightmare is directly enabled by the often seen rule that a thread take trumps everything. For the life of me, I can't understand why sellers continue to specify the rules this way. Why would a seller want to allow this messy situation to occur...i.e., why would a seller desire to specify rules that allow a thread poster to supersede a fully completed PM deal where the seller or PM taker simply hasn't had time or opportunity to update the thread? In general, I just don't understand the incentive on any seller's part to use any "take rule" other than "first take wins, whether in the thread or via PM". Doing otherwise seems a bit , unless the seller just intentionally desires to set the stage for drama. over. It's completely stupid. I posted this in the thread, but going to repeat it here. By these rules, as a seller I can agree to a deal via PM and just wait to post "SOLD" for a few hours and hope someone hits the BIN at a better price. The potential buyer who sent the PM obviously read the thread and therefore should be aware of the rules. Your example doesn't work. The seller stated his terms so kudos to him. "Trumps all PMs " that would include agreed upon deals is stupid. It lacks common sense and good business sense. Your opinion which you are entitled to but his rules do not violate board rules and were stated up front. You have no case other than simply not liking the rule. His decision followed his rule. The seller did nothing wrong and is common practice on the boards. This. There's something to be argued if the rules were not so clear. The seller was pretty good about detailing what he was going to consider when awarding the book to a buyer. Let's be honest, he could have said that he's not selling to anyone on the west coast or anyone named Branget. You could argue that those rules were stupid and didn't make good business sense. But if known up front, the rules are still the rules.

  5. There are 2 solutions. The seller sells or the buyer walks. That's it. They both walk and not deal with each other Except the buyer agreed to buy a book, paid for the book, and got bent because he couldn't get an update from the seller on the shipping of the book. It's well within the buyer's right to put the seller on blast. If the seller didn't like the reaction, he should do better with managing his business. Now you have a hot book, that I'm pretty sure is selling for more than what the seller offered it for, being held from a buyer that bought and paid and had every intention of completing the deal. Pretty cut and dry. Make it right or seller does his time on the PL.

  7. I am nominating luckycomics, Robert Cano, to the Hall of Shame. This user had multiple transactions with other board members in his last sales thread. Link to sales thread. My first payment to him was 31 days ago and I've sent him multiple PMs to alert him of the discussions taking place. Luckycomics disappeared after collecting payment from numerous board members. Comics were never shipped and replies to messages for updates/status were never received. In every instance where the buyer sent money to luckycomics, a paypal dispute had to be opened for paypal to reverse the charge. In no instance were these reversals given by luckycomics, rather they were provided under Paypal's buyer protection. Based on posts in this thread and some PMs that I've received, there are 7 known boardies that sent money and had to submit paypal disputes. Including: brownchikano, asteroid-comix, carter3175, Scturo, Gsims718, ComicBookQuest, Torgaddon At this point, his actions put luckycomics with the worst of the worst and his inclusion into the HOS is up for vote.

Based on posts in this thread and some PMs that I've received, here are the ones that I know had sent money and had to file a paypal claim (feel free to correct me if anyone has been mistakenly put on the list): brownchikano, asteroid-comix, carter3175, Scturo, Gsims718, ComicBookQuest There are others that purchased in the thread, but I'm awaiting the extent of their dealings before including them in the above. Included: Bunky Brian, mumby, boboset So, no fewer than 6 and as many as 9.
  9. Got a refund on the transactions this morning. I've got one and one is in the final stage. No fewer than five buyers paid this guy and he skipped with the cash. As a result, I'd like to formally nominate luckycomics for the HOS.
  10. Group shot of the JSC Spidey statues from sideshow. I got the Spidey today and was pretty impressed. Like the Gwen, the statue is a lot taller than I thought it would be and does not fit in my glass cabinet. The detail and stand are incredible.
  11. Asking for advice and then fighting those that seek to give because it's not what you want to hear is generally what brings out the butthurt on these boards. Take some responsibility for your actions and provide your eBay ID.
  12. Sounds reasonable remember, ebay doesn't let a seller open an unpaid item case an hour after the auction ends. There are time lines put in place for buyers and sellers. Pretty sure it's like four days, isn't it? I know you used to not be able to open one prior to seven days.

So, I asked for a link to his ebay profile and he sent me this: http://www.ebay.com/usr/havajoe54?_trksid=p2059210.m2749.l2754 That was the last contact I had with him..I informed him I had sent him a message on eBay and he could please reply to it with his CGC board username. He has read my message here on the boards, but did not reply here or on eBay and I have not heard from him again. Very shady..glad I didn't send him my money. I messaged this guy again and opened a paypal dispute. I hope for the best, but am prepared for the worst. I also found this with a quick google search of his name and address.   14. Same situation here, but he has communicated. I pm'd him on 7/16 about some books that were paid for back on 7/5 and and others that were paid for on 7/9. He messaged me on 7/16 and said he had someone that didn't pay and was trying to ship everything at once (post office was on the other side of town). I didn't get tracking, but I see it on the paypal payment. Same deal, looks like they were printed but not dropped off. I figured I'd wait until the start of the week to see if they moved before I got concerned.
  15. I wouldn't ship it back to the seller. I would either get a partial refund as others have suggested or send it myself for a re-holder. If my math is right, we're talking about a book valued at $800. For a book of that value, I would ensure that I was protected from loss. The transaction has been completed at this point, so there would be zero recourse for you if something went bad in the course of shipping back to the seller and you ultimately getting the book from CGC. Pictures of the damaged slab should be enough evidence, so I'm puzzled as to why the seller would want the book shipped to them. Even if they have a dealer account, they could send you the invoice with their dealer number on it, pre-filled, and you could ship the book to CGC to take advantage of any benefit that they would have in sending the book. Which would be zero as dealers don't get a discount on re-holders. I'm sure the seller is legit and has no nefarious motives, but I've seen too many threads where this doesn't turn out well for the buyer.
  16. I invoiced him, 2 weeks ago, for his purchases in my sales thread and never heard anything after. He hasn't read the PMs. He invoiced me for a purchase around the same time. We had been discussing some other books though so I had not yet paid. My last PM is sitting unread. Hope the guy is alright.
