Anyone have outstanding transactions with j miklia ?

 

He :takeit: in a thread of mine in December, invoiced 12/15,I hadn't heard anything and followed up on 1/10, still no response(nor is the last PM read).

I need to nominate rawisokv, on Nov 17 I purchased a comic he is in possession of. He has promised to mail me the comic 4 times and still hasn't.

Details?

I purchased a comic from Anthony Castrillo off of the forums. On Nov. 17, 2012. On Nov. 20, 2012 I learned Anthony didn't have the comic in his possession. It was (and still is) in the possession of rawisokv. Four times Anthony told me my comic was on its way (Nov. 20 and again on the 29th, also Dec 29 and Jan 2)after the first two times Anthony wasn't able to get him to mail off the comic so I contacted rawisokv on Dec. 22, 2012 to attempt to find out what was going on (and from that point forward Anthony and I have both been trying to get him to mail my comic). At that time he informed me he knew about the arrangement and would be shipping me the comic the week of Christmas, nothing, then he was going to mail it Jan 7, nothing. Then Jan 12, still nothing now he tells me it will happen Monday.

 

I have a question on your nomination before you decipher POV's message and adjust the PL. :insane:

 

Why aren't you getting your money back from Anthony Castrillo??

He sold you the book but it was in rawisokv's possession when he sold it to you, it's the seller's responsibility to get the book to you. Is there an explanation as to how or why the book got in this guy's hands?

 

I don't have any problem with rawisokv going on the list since he's done nothing to defend himself or follow through on commitments he made to you but if you don't get your money back then he shouldn't go on the list alone.

I had no other ideas for a new username, so binary it is. Had to go with just the letter since my full name was too long in binary.

I am working to get a refund from Anthony, and ultimately if he won't I will need to consider doing that. Rawisokv has gotten to the point where he has cut off communication with me. But it all started when I unknowingly entered into a 3 way deal. Anthony sold the comic to rawisokv who didn't like it and asked Anthony to do a new one and he would send the original back. Then Anthony listed it for sale and I purchased it. Then Anthony told him to send me the comic. The problems are obvious, Anthony trusted Rawisokv to follow through with their agreement and he should have waited until he had possession of the comic before listing it for sale.

I don't think you have the right to nominate Rwisokv for the PL. You made no deal with him. You promised him nothing. You gave him nothing.

 

You did however make a deal and pay for something from someone else. For whatever extenuating circumstances, that person has not been able to get you the book. Your gripe should be with that person, who entered you unwittingly into a very confusing situation. They should either pay you back or give you the book. Especially when THAT is the person that has a long and extended history here of not following through timely on promised (and paid for) deliverables.

 

At least thats the way I see it. You may really want said book, but its not your job to go chasing after something that the seller should never have sold to you. Just have him refund the money to you, with the agreement that if he gets it back within a specified time, you then pay and he sends it. I think that sounds reasonable.

Rawisokv was responsible for shipping and did not. The source of the problem is clear.

 

I can always add him for another transaction if that makes you feel better.

You should share that history to support the nomination and warn the community.

 

We are in agreement on the source of the problem but there's only one party who brought that problem person into playing any role in the transaction and he should be reimbursing the buyer.

 

If rawisokv has AC's property and won't give it back that's his issue - - you can't sell stolen property and give your buyer a description of the burglar so he can report it to the police.

All kidding aside, this clusterfark demonstrates a crucial point. Every contract is a promise, but every promise is not a contract. The difference is critical - it is consideration. As Revat said, "You promised him nothing. You gave him nothing."

 

It appears as if Rawisokv is acting toolish for making promises and not keeping them, but that is not sufficient for making the PL. There is no contract between phantomewan and rawisoky because there has been no consideration, and therefore he should come off the list.

 

While the PL has no enforcement mechanism other than shunning, it should have some basic elements of contract law as its underpinning. Why reinvent the wheel?

Yes, and its a bummer especially because it appears at least AC is still trying to resolve the problem, but that does not change the fact that AC is responsible.

As I understand the buyer's story, the root issue is that this "3-way" was not in the original bargain- "But it all started when I unknowingly entered into a 3 way deal". This is why IMO AC is responsible first, because he essentially made his buyer hostage to a third party who, as it turns out, is unwilling or unable to mail a book. 2c
