He's in the wrong then. The book should never have been on hold. it should have been off the market. You agreed to his terms (no paypal, no shipping out of the US) so the book is yours. My reason for pointing out that thread and Rick's take it was because I thought he (the seller) was in talks with someone (i.e. Hey could you do $9,900 etc) and had put it on hold during the discussion and thus the unconditional :takeit: should take it, but yours was unconditional as well, and first in line.

I would have thought all the risk was Randy's. 10k and no buyer protection.

 

This is what I don't get when sellers say "I don't know about you" on non-paypal/credit card deals. Buyer has zero protection. I've done these deals before knowing full well that I could possibly lose out on the money, but took the risk based on the seller's rep.

 

The only repercussions would be the buyer trashing the seller online for something, but the buyer should do whatever they can in the even of a scam. Idk, seems like the lion's share of the risk falls with the buyer outside of ppal or cc.

Only way the seller would have been in the right here is if he had told quadman that he was not willing to use a third party to handle the transaction and then asked quadman if he still wanted to do the transaction without one.

 

quadman78's request to use a mutually known third party as a middleman is not an unusual one on a $10,000 book between a buyer and seller who aren't familiar with each other.

I think if this is looked at in reverse there is a "normal" that is here applicable. If Randy, after placing the I'll take it via PM, had backed out of the deal, and the seller had come here complaining, there would have been no doubt as to fault. The reverse than must also be true, and here the seller is at fault.

 

"Normal rules" can only mean what is conventional on the Boards. It is at the very least common practice, and indeed enforceable practice, that I'll take it establishes an obligation. Randy put in fact no conditions on the I'll take it. 2c

I did not accept your Ill take it through PM. You had a conditional ill take it (Out of country, 3rd party) and I had a buyer who had no conditions. I elected to sell to the person with no conditions

I said HOLD not you got it or anything like that. My post said USA only and you are Canada. You have a US address ok but you wanted 3rd party and have a year on the boards and live in a different country. That's too many variables for a 5 figure book. You did not post in the thread and even if you did you still had conditions. I am not taking a shot that everything will go right with a 10k book.
