I'm just curious why there's such a disdain for these types of listings. Did I miss some major drama?

 

They're a lottery. Get the proper paperwork filled out and buy a Conner store or a casino. I wouldn't want anything I sell associated with gambling.

I still think your Mystery Box sale would be allowed so why don't you let the Mods sort that out. They said they'd handle it on a case by case situation. I feel having random books thrown in like you have done. Arch said specifically that they'd handle it on a case by case situation and *poofed* one or more that were active. They did NOT *poof* your thread.

 

I say try it out. If they *poof* it, we'll have a definitive answer.

 

I think it's all about the contents of the boxes. You were very specific in like your Mystery Boxes are incentive enough (I'll tell you when I get mine :baiting: ), but I don't see anything wrong with in addition to the boxes that "there will be a NM #98 and Saga #1" etc. etc. I think people can absolutely show the contents of their boxes. You don't know what you get, but everything is there that you COULD get. Having a big ticket book randomly placed on top - it's still very grey. (shrug)

 

 

The problem with revealing some of the books you MIGHT get is that some people might be induced into buying based on the CHANCE to get a certain book, and might not have bought a mystery box otherwise. I have no interest in receiving a ASM 300 or NM 98, but might be convinced if they included a X Men 268 2nd print CGC 9.8, with the consolation prize being one of the other books of equal or value. But I can tell you that if I got the book I wanted, I would feel like I won a little LOTTERY, because equal FMV value or not (which are subjective), it is a LOTTERY. CGC mods have made a judgement about the value of the 'ticket', but not every state sees it that way.

 

I think the case-by-case is ultimately going to be a tough ride for CGC, when someone disgruntled reports them to their state gaming commissions. If I were CGC, I'd say it wasn't worth the trouble.

 

 

ON the other hand, if you don't reveal what you're giving away, you are in direct violation for Rule 6 for CGC forum sales.

No, of course not! :grin: I meant you offered up an idea of the great books that would be regularly mixed in the boxes. Obviously that's not going to be in every box, but it gave would be buyers an idea.

I actually have no problem with the basic idea of a mystery box as constructed on these forums. If I saw the right books offered, I would actually buy one to get the chance of winning a rare book that I needed for my registry.

 

My contention is that most of the mystery boxes are de facto lotteries/raffles, and when they're not, they don't conform to Rule 6. So I think that its in CGC's best interests to not deal with them at all. Or they can keep being inconsistent with their own rules AND risk some type of regulation by state authorities.

I'm selling 10 mottery tickets made of gold for $500 each. The weight of these mottery tickets makes them worth $600 each in FMV gold weight. One of the mottery tickets will have "WINNER" etched on the back. It will be randomly given out to one of the buyers. If you receive that one, show me and I will give you an additional brick of gold.

 

If I got the winning mottery ticket, I will have won this lottery.

 

The intrinsic value of the ticket vs the purchase price does NOT have a bearing on weather or not this is a lottery.

 

The fact that CGC has decided to allow this specific type of lottery (where the ticket has intrinsic value equal to/higher than the purchase price) DOES not make it less of a lottery, just that CGC mods have decided to allow this type of lottery.

The mystery box sales are a well-disguised raffle/lottery. You're paying for the chance to get some unknown beyond what you paid for with them. It could be the kicker book that gets drawn for or the contents.

 

No one buys them with the intent and hope that they’re going to $50 (or whatever they sell for) dollars’ worth of drek. Put the same drek out in the open in the same lots, slap a $50 (or whatever they sell for) price on them and see how many get claimed. The seller's like this format because they can entice purchases by giving the chance for folks to get more for their money. That's a lottery or a raffle any way you cut it.

 

Not that I would ever participate in them myself, but would be glad to see them gone from the market place as they just take up real estate.

Even with a basic give away, (e.g. give you a shot at a prize when you buy their stuff) companies are usually held to a "no purchase necessary" requirement by law. So people can "sign up to win" even if they buy nothing.

 

Frankly, I don't know all of the ins-and-outs of the laws regarding this kind of thing so the actual moderation standard will be something like "if it smells like a raffle / game of chance / lucky few give away, then it's out."

 

In comicalgem's sale, the purchaser is assured to receive comics that have a higher value than the amount paid. To me, this seems to be fine, in regards to what I bolded in the quote from Architect.

 

If he had set it up differently (say, boxes are $150 each, 9 will will have FMV of $100 and one will have a Walking Dead #1), then that would be a raffle.

 

My birthday is at the end of the month which always puts me in a wacky giving mood. So here's what I'm offering: Ten Mystery Boxes at $150 shipped each. If all ten sell I'll have a drawing where 10th name drawn receives X-Factor 6 CGC 9.8.

 

What else will be in the boxes? It's a Mystery! However be assured your box's contents will be worth what you paid. I have comics, TPBs, and more that I'll put into these boxes.

 

Check my feedback thread below and you will see previous buyers all happy with their boxes. Thread crapping allowed and PMs welcomed.
