  2. You are perfectly entitled to sat anonymous and it has done nothing to hurt his reputation AT ALL. The damage to his has been caused by his own conduct. He is continually obfuscating and directing attention to irrelevant issues. He knew about the restoration concerns when you inquired and did not disclose even though you specifically asked about it. He has taken your money and has not refunded despite repeated requests. And how now been shown to be buying other books.

  6. Where did he say he doesn't have the money to refund? I saw the part where he says he doesn't have the money to submit it to CGC for a review, and offered someone to do it for him, but he never said he isn't refunding the buyer (he also never said he was refunding him/her either for that matter) This is what has been communicated to me from the buyer in private messages.
  7. Sorry had to edit above. Take it was 2:25am and response to inquiry about restoration was 01:50, in any event both occurred after he had responded to my question about restoration.
  8. I have also just confirmed that the "take it" in pm was at 02:25 and he was specifically asked via by the purchaser at 01:44 if it was restored and responded to that inquiry at 1:50. So he knew about the restoration concerns before the sale, was asked about it and did not disclose, and then allowed payment to be completed, and now has spent the money and can't/won't refund. See my PMs below. I guess I could have been more forceful in the first instance but I wanted to air my concerns in private and gently so as not to offend. In the past when I have done this with other boardies the immediate response was to pull the book and apologize profusely.
  9. I only get the win not the book. He said he sold it to his "anonymous" friend that buys his books all the time, but he can't do anything that its restored. Sucks to be his friend. I am pretty sure he has just given the book away to you if you agree to pay slabbing fees and then disclose the restoration notes. and I know for a FACT he has not refunded the original purchaser. Also on the claim that he did not have enough time to take the book down. He posted it for sale at 12:52, at 01:08 I sent him a pm raising my concerns that it was restored to which he replied at 01:24am but it was not changed to being sold until 02:28 am.
  10. You can't give the book away unless you have made the purchaser whole again and refunded their money in full. If you have not done this they have a lien over the goods.
  11. A great book. Did you buy this off the boards raw? I think I remember the sale. From memory the scan was beautiful and looked NM- too me.

It seems like there really isn't a legit excuse to make an issue of somebody bringing restoration to everyone's attention, unless, of course, you knew about it already and didn't disclose it in the listing. Common Sense Threadcrapping should also apply to the grading in some sales threads. I know grading is subjective but there is a current sales thread with terrible over grading, there's nothing subjective about it. This should be pointed out too so that the sales forums can at least carry a higher standard than eBay. I think you can pm and ask for bigger better scans, and/or bring it up here. The problem is not that there aren't reasonable people with legitimate concerns, the problem is that its a slippery slope and things can spiral easily and often, so ALL threadkrapping real or perceived is banned. I think that's the most reasonable rule they could come up with. If a given person doesn't like the grading, they can choose not to buy and/or make returns. Eventually the seller will either figure it out or not, the general public does not have a responsibility to inform the seller of the best ways to grade, price, market, or sell within their thread. If he dies, he dies. I agree thread krapping can become a big problem. I am on some facebook groups for comics. Loose enforcement of thread krapping rules means they have become virtually worthless as a venue to sell and trade. Every post gets a disparaging comment about price....
  13. It is good you are trying to explain. I would simplify my explanations, remove the graphics and address directly: 1) Whether you knew about the restoration 2) Who the purchaser is. Its fine to make mistakes. I think this board, while prone to witch hunts, can be forgiving if you are honest and contrite.

  16. I don't know enough to speculate on price but it does look like it has been Costanzed. It is absolutely impossible to determine whether or not any of those "defects" were caused by pressing. 7.5's don't come around for auction very often and the last 8.0 that was on comic connect a few months ago (also rumored to have been pressed) set a new GPA high anyway. I suspect this one will do quite well especially with the Marvel movie buzz swirling around now. -J. Not disagreeing with you man. Just saying it looks fugly on the open edge.

  20. That was my thought. As far as mandatory posting an i'll take it in the thread, I haven't bought a book for myself in over two years. When I do purchase, it's usually for a gift and I don't want it known publically. You would be surprised what constitutes an offer and what constitutes a request for more information. In Harvey v Facey [1893] the following was held not to be an offer: Harvey: "Will you sell us Bumper Hall Pen? Telegraph lowest cash price-answer paid". Facey: "Lowest price for Bumper Hall Pen £900." Is the difference whether one is phrased as a question or a statement? So this would also be only an inquiry: "Could I give you $200 for the FF 45"? Do I have this correct? Don't quote me on this, but I think whether a statement is an inquiry or an offer is a question of fact to be determined from the circumstances and in order to be an offer it must be an unqualified statement evidencing an intention to be legally bound.
  21. I do not think it is appropriate. But I had sent the seller a pm before the sale was completed letting him know I thought the book had CT in the clouds. He replied saying he did not think it was restored and then the book sold. Just thinking out loud, but... Since it "sold" via pm we don't really know if it sold or if that was a response to potential resto being pointed out. Usually a book being marked "sold" ends conversations quickly. Interesting point. That is certainly a possibility.
