This is interesting to read when it comes to rights changing hands from 2006.

VARIETY: Marvel Making Deals For Tidal Wave (APRIL 27, 2006)

---------------------

Jon Favreau is set to direct Marvel Studios’ live-action feature “Iron Man,” which will now be distributed by Paramount.

News is part of a wider announcement from Marvel outlining a barrage of directing and writing deals for a slate of films it is developing with aims to independently finance out of a $525 million fund from Merrill Lynch.

All the pics but one, “The Incredible Hulk,” will be distributed by Par[amount Pictures] under an existing service agreement.

---------------------

This is where the Phase One movies kicked off via official announcement.

---------------------

Marvel disclosed it is pursuing a second “Hulk” pic, despite the so-so performance of Ang Lee’s 2003 film. Zak Penn, who has collaborated with Marvel on several features, including the upcoming “X-Men: The Last Stand,” will pen the -script for what’s being called “Incredible Hulk.”

---------------------

David Duchovny was going to replace Eric Bana at this point.

---------------------

Edgar Wright (“Shaun of the Dead,” “Hot Fuzz”) will direct and co-write with Joe Cornish the feature film “Ant Man.” Always seen as a bit of a ridiculous super-hero — his power is to control ants — duo plan to give the big-screen “Ant-Man” a comedic twist.

---------------------

Ant-Man was going to be a Phase One character.

---------------------

Marvel has tapped scribe Andrew Marlowe (“Air Force One,” “Hollow Man”) to pen the -script for “Nick Fury,” based on Marvel’s military super spy.

---------------------

And Nick Fury was going to have his own spy movie.

Another character out of their control.

Marvel Studios Can't Use GLADIATOR Or THE SHI'AR

---------------------

Guardians of the Galaxy director James Gunn was asked about using Gladiator in which he responded he can't because Marvel doesn't own the rights.

"No. Marvel Studios doesn't own him. Otherwise I'd love to use him," Gunn responded on Facebook.

Gladiator is a member of the Imperial Guard - belonging to the alien race known as the Shi'ar- which is owned by Fox as a part of the X-Men.

Fox Reportedly Gets To Keep The Rights To ELEKTRA

(2012)

-------------------

In almost an aside, Variety reports that despite losing Daredevil, Fox still owns the rights to Elektra.

This is odd because Elektra was the love interest in the 2003 Daredevil film and Fox's 2005 Elektra film was set in the exact same universe as the Daredevil film, taking place after it's events.

-------------------

Marvel Confirms It Has Rights to 'Daredevil' Villain Kingpin and Elektra

(2014)

-------------------

What wasn't known at the time is whether Daredevil characters Kingpin and Elektra came with this deal. Today, Kevin Feige reveals in an interview with IGN that the studio does have the rights to Elektra in full and at least partial rights to Kingpin.

"Elektra I think we have. I think that was part of Daredevil, and that's clean and simple. Kingpin we either have or somehow share. I'm not 100 percent clear on that one."

-------------------

It's so confusing sometimes, even Kevin Feige tried to declare Marvel had the rights back, but had to do it in a way he wasn't even sure. But the common contract someone had dug up is a ten-year commitment (make a film or turn the rights back over).

Daredevil (2003, Fox) => Marvel gets rights back in 2013

Elektra (2005, Fox) => Marvel should now have the rights back in 2015

Who owns the rights to Jim Hammond, the GA Human Torch? We did see the android body on display in Captain America... but still.

Marvel.

So theoretically could we see an Invaders movie with a "Human Torch" ? Because it may not exactly be a Quicksilver / Scarlet Witch thing as Torch is a primary character in the FF Fox deal.

For the record, I would love to see an Invaders episode on Agents of SHIELD or a full length feature film.

And you may see it. Though Feige said something last year about Namor's film rights being divided.
