Seller sold an incomplete book to me - How would you respond? 10 10

If I choose to not inspect it right away (which I have done a time or two) I also accept that I just made it MY problem. I wouldn’t even bother the Seller at this point.  We’ll never know if they did this on purpose or not but I think it’s too late to ask them to help make up for my bad decision.  It’s 100% my problem at this point.  I definitely wouldn’t give them return business though.

And I've had a buyer ask to  return a book 3 months after they purchased because they finally checked and it wasn't as good a candidate for pressing as they thought.  I refunded the money but I think it's completely understandable to set some sort of reasonable limit for returns.  Frankly, 30 days seems reasonable to me.  I would never try to return a book after 30 days unless I discovered some sort of serious malfeasance by the seller (micro-trimming, etc.). 

Add my own "Tales To Embarrass":

Years ago I bought a raw midgrade SA moderate-key from a well-known/respected boardie at a con. I didn't inspect it at the con, very crowded and didn't want to bother asking for a space to open and page-through a SA key with all the hustle going on. I just bought it. Seller didn't mention anything about it.

Brought it home at the end of the day. Went back the next day and did more shopping (accumulating mass-quantities). Once the con was over, I took out my SA key from the boardie and immediately noticed a small ad was cut out of the back cover.  Con was over, and I didn't want to harass the boardie for my own lack of judgement in paying for a moderate-key book I didn't inspect on-sight or even later that day. 

Lesson learned - inspect what you buy ASAP.

But one would have to open the book to see what’s inside it. In this case he didn’t feel comfortable, so even 60 days wouldn’t have been enough.

@O Doyle Rules I understand not wanting to put his name out there I guess but can we see a screen cap (name withheld) of him admitting his fault? I am curious of his wording.

I'm at a loss here...you are trying to get the seller banned, but won't out him. In addition you won't tell us the name of the book.

How about the publisher and series? That would help determine if the page count was unusual.

This is ridiculous.  I had to sift all 12 pages and still didn’t find out what the book is or who the seller is?

Ebay's TOS theoretically are there to protect both buyers and sellers.  It's supposed to be a two-way street.  If a buyer goes through Paypal to get a return after 30 days, they should have their Ebay account suspended for violation of TOS.

If you had counted the pages, we would not be here.

At best you are 50% to blame. At worst 100%.

Who doesn't check a book before they send it to CGC?

Serious question - why would you NOT check for an internal tear, a missing ad or a stain?

And now you are trying to get the seller banned from Ebay when you both share blame.

Wow what an interesting conversation, I read about halfway through but it seems to be the same back and forth. As someone who buys and sells on ebay fairly frequently its easy to put myself in both the buyers and sellers situation. As the buyer because I didn't inspect the book and am out of the window for a return would just take the $100 sell the book and move on without repeating that mistake again. As the seller its even easier since I misrepresented(accidently I hope) the book i'd let the buyer send the book back for a full refund but not the grading fees.

I will put a twist on the discussion.

At the start of the pandemic when prices were slowly starting to go up I decided to put a bunch of silver age raws up on Ebay. They were getting snapped up like crazy which was great because I used the cash to pay off my bills (another story for another day). One of the books was an early X-Men comic that I bought from Heritage. They said it was an FN, and I thought that was optimistic and listed it as VG/FN. It sold in the rush. 

A few weeks later the buyer came back to me and said he sent it in to CGC and it came back with a green label because there was a page missing. I felt terrible because I did not count the pages - I trusted the book was complete because Heritage said it was, and so I only looked at the condition. However, the guy who bought it got the book, sent it to a presser, and then it went from the presser to CGC. My opinion was that although I made a bad mistake and was more than happy to try to make things right, the buyer also played a role in this as did the presser. It went through 4 hands (Heritage, mine, the buyer, and the presser) and no one spotted the missing page so it did not feel like the blame was all mine. 

I offered him two choices. He could send the book back to me for a full refund of what he paid on Ebay (which he correctly did not take) or else I could refund the value difference between what he paid and the value of the qualified book. He took the second option and I ended up giving him about a 1/4 refund or something along those lines and he was completely happy with it. In no way, shape, or form, did I ever even remotely consider compensating him for the grading part of it - I believed and still believe that it is 100% his responsibility to check his books before sending them in.

As it was yours to inspect it before you put it up for sale. But you admitted it as did the OP. Kudos to you for realizing it and making good on it.

AGAIN, inspect each book you receive and before you put up to sell carefully. Don’t trust ANYONE other than yourself. A lesson often hard learned for some.
